When using facial recognition for law enforcement activities, we guide customers to set a threshold of at least 95 percent or higher,&quot; an Amazon spokesperson told CNET by email.<\/p>\n<p>But an ACLU lawyer tells CNET that Amazon doesn&#039;t necessarily steer law enforcement agencies toward that higher threshold \u2014 if a police department uses the software, it&#039;ll be set to the same 80-percent threshold by default and won&#039;t ask them to change it even if they intend to use it to identify criminals. &quot;Amazon makes no effort to ask users what they are using Rekognition for,&quot; says ACLU attorney Jacob Snow.<\/p>\n<figure><img decoding=\"async\" src=\"https:\/\/www.cnet.com\/news\/amazon-facial-recognition-thinks-28-congressmen-look-like-known-criminals-at-default-settings\/\" alt=\"employee-verification\"\/><img decoding=\"async\" src=\"https:\/\/cnet4.cbsistatic.com\/img\/kGrvNO8ODHo3_EI1exmK4xFgi4g=\/970x0\/2018\/07\/26\/53a051ce-175b-4dca-abfd-32955dee0827\/employee-verification.png\" alt=\"employee-verification\"\/><figcaption>\n<p>The ACLU says that even when it comes to facial recognition for security purposes, Amazon&#039;s website suggests that the 80-percent confidence threshold is sufficent.<\/p>\n<p>                                                     Screenshot by ACLU                                                 <\/p>\n<\/figcaption><\/figure>\n<p>A source close to the matter tells CNET that when Amazon works with law enforcment agencies directly, <a href=\"https:\/\/www.cnet.com\/news\/amazon-and-orlando-police-department-reinitiate-facial-recognition-pilot\/\" rel=\"noreferrer\" target=\"_blank\">like the Orlando Police Department<\/a>, it teaches them how to reduce false positives and avoid human bias. But there&#039;s nothing to necessarily keep other agencies from simply using the tool the same way the ACLU did, instead of developing a relationship with Amazon.<\/p>\n<p>It&#039;s worth noting that <a href=\"https:\/\/www.cnet.com\/news\/facial-recognition-software-inaccurate-in-98-of-metropolitan-police-cases-reports\/\" rel=\"noreferrer\" target=\"_blank\">false positives<\/a> are (currently!) an accepted part of facial recognition technology. Nobody \u2014 including the ACLU \u2014 is saying police would arrest or (God forbid) shoot someone based on a false match alone. Facial recognition narrows down the list of suspects, and then humans take over. Recently, facial recognition helped ID <a href=\"https:\/\/www.cnet.com\/news\/facial-recognition-helped-identify-suspects-in-novichok-poisoning-case\/\" rel=\"noreferrer\" target=\"_blank\">the Russian assassins who poisoned a spy in the UK<\/a>, as well as <a href=\"https:\/\/www.cnet.com\/news\/how-facial-recognition-idd-the-capital-gazette-shooter\/\" rel=\"noreferrer\" target=\"_blank\">the Capital Gazette shooter.<\/a> <\/p>\n<p>And Amazon didn&#039;t actually create <em>that<\/em> many false positives even at the 80 percent confidence ratio, compared to, say, <a href=\"https:\/\/www.cnet.com\/news\/facial-recognition-software-inaccurate-in-98-of-metropolitan-police-cases-reports\/\" rel=\"noreferrer\" target=\"_blank\">the UK Metropolitan Police&#039;s facial recognition tech<\/a>.<\/p>\n<p><a href=\"https:\/\/www.aclu.org\/blog\/privacy-technology\/surveillance-technologies\/amazons-face-recognition-falsely-matched-28\" rel=\"noreferrer\" target=\"_blank\">But the ACLU worries<\/a> that Amazon&#039;s false positives might bias a police officer or government agent to search, question or potentially draw a weapon when they shouldn&#039;t \u2014 and we&#039;ve all seen how those encounters can turn deadly.<\/p>\n<p>The ACLU also provided CNET this statement: <\/p>\n<blockquote>\n<p>Amazon seems to have missed, or refuses to acknowledge, the broader point: facial recognition technology in the hands of government is primed for abuse and raises significant civil rights concerns. It could allow \u2013 and in some cases has already enabled \u2013 police to determine who attends protests, ICE to continuously monitor immigrants, and cities to routinely track their own residents, whether they have reason to suspect criminal activity or not. Changing the threshold from 80 to 95 percent doesn&#039;t change that. In fact, it could exacerbate it.<\/p>\n<\/blockquote>\n<p>Should Congress regulate facial recognition? <a href=\"https:\/\/www.cnet.com\/news\/microsoft-exec-government-should-regulate-facial-recognition-tech\/\" rel=\"noreferrer\" target=\"_blank\">Microsoft thinks so<\/a>, and now 28 members of Congress have some very personal food for thought \u2014 95-percent confidence threshold or no.<\/p>\n<p><strong>Update, 11:07 a.m. PT: <\/strong>Two of the Congressmen who were mismatched with mugshots, Reps.
