It comes just over a year after the Danish politician announced a <a href=\"https:\/\/www.politico.eu\/article\/vestager-hits-google-with-e2-42-billion-fine\/\" rel=\"noreferrer\" target=\"_blank\">separate \u20ac2.4 billion ($2.8 billion) financial penalty<\/a> linked to some of the tech giants search services. Google denies wrongdoing and is appealing both charges.<\/p>\n<p>\u201cWhat we want is for Google to change its behavior,\u201d Vestager told reporters on Wednesday. \u201cThis is a market, and there are rules.\u201d<\/p>\n<p>The antitrust penalty represents the largest ever antitrust fine levied by Europes competition authorities against a single company, and marks a significant step by Vestager in her <a href=\"https:\/\/www.politico.eu\/article\/margrethe-vestager-technophobe\/\" rel=\"noreferrer\" target=\"_blank\">ongoing battle<\/a> with the U.S. search giant.<\/p>\n<p>By focusing on Android, which is free to use and powers more than three-quarters of the worlds smartphones, the European Commission <a href=\"https:\/\/www.politico.eu\/article\/google-android-antitrust-europe-margrethe-vestager\/\" rel=\"noreferrer\" target=\"_blank\">is taking direct aim<\/a> at Googles aspiration to be central to peoples digital lives increasingly run through mobile devices.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/g8fip1kplyr33r3krz5b97d1-wpengine.netdna-ssl.com\/wp-content\/uploads\/2018\/07\/Android_transparent.gif\"\/><\/p>\n<p>It also represents a serious setback for the search giant, which must now open up its Android software to greater competition. That includes permitting phonemakers greater freedom to choose which digital services appear on peoples handsets, potentially hampering its ability to garner revenue from online advertising \u2014 still its core business \u2014 if consumers shift their online attention elsewhere.<\/p>\n<p>Google was quick to rebuff Brussels charges.<\/p>\n<p>In a <a href=\"https:\/\/blog.google\/around-the-globe\/google-europe\/android-has-created-more-choice-not-less\/?utm_source=POLITICO.EU&amp;utm_campaign=6ddab401e7-EMAIL_CAMPAIGN_2018_07_18_12_54&amp;utm_medium=email&amp;utm_term=0_10959edeb5-6ddab401e7-190069369\" rel=\"noreferrer\" target=\"_blank\">blog post<\/a>, Sundar Pichai, the companys chief executive, said that Android has created more, not less, competition for phonemakers and app developers across Europe and beyond. He added that consumers have benefited because of the ready access to cheap smartphones, some of which now cost less than \u20ac50 ($58).<\/p>\n<p>\u201cTodays decision rejects the business model that supports Android, which has created more choice for everyone, not less,\u201d Pichai wrote. \u201cWe intend to appeal.\u201d<!--more--><\/p>\n<p>The fine, though, is unlikely to threaten Googles ongoing business, at least in the short term. It represents roughly 16 days of the search giants revenue, according to the companys 2017 financial report, although investors are likely to ask questions at its next earnings on July 23.<\/p>\n<h3>Vestager versus Google<\/h3>\n<p>Europes charges allege that Google makes unfair use of Android to maintain its dominance in online search.<\/p>\n<p>As part of <a href=\"http:\/\/europa.eu\/rapid\/press-release_IP-18-4581_en.htm\" rel=\"noreferrer\" target=\"_blank\">Wednesdays decision<\/a>, Vestager highlighted complex contractual agreements that Google demanded phonemakers sign if they wanted to access the companys popular digital services, including its app store, known as the Play Store.<\/p>\n<p>The agreements required that manufacturers pre-install Google search and its browser onto smartphones if they wanted to access the app store. That allowed the search giant to gain an unfair advantage over rivals and potentially hamper consumer choice, according to the EUs statement.<\/p>\n<p>In particular, Europes competition chief said the search giant had illegally paid manufacturers to exclusively install Google search on their devices. She added that Google had prevented phonemakers from accessing the companys digital services like its app store if they did not exclusively use Googles version of Android.<\/p>\n<p>\u201cIts a very serious illegal behavior,\u201d Vestager said. \u201cWhat would help competition would be for other players to have a go and reach consumers.\u201d<\/p>\n<blockquote>\n<p>Vestager has repeatedly claimed the investigations are not unfairly targeting U.S. tech firms in order to level the playing field for European rivals.<\/p>\n<\/blockquote>\n<p>Google will now have 90 days to end what the EU deems its illegal activities or face fines of up to 5 percent of the daily global revenue of Alphabet, its parent company, or roughly $12 million a day. In particular, it is expected to grant greater permissions to phonemakers and telecoms operators to access the companys app store without being forced to pre-install either Google search or its web browser.<\/p>\n<p>These changes, according to industry watchers, could hit Googles global dominance in search and online browsers, although the companys services remain widely popular with consumers across Europe, the U.S. and beyond.<\/p>\n<p>Others said Google may start to charge phonemakers for access to its version of Android, which could potentially raise costs for phonemakers worldwide that could eventually be passed on to consumers.<\/p>\n<p> <img decoding=\"async\" src=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2018\/07\/GettyImages-968495144-2-714x476.jpg\"\/><\/p>\n<p>Rival camps have taken sides depending on their views of Googles position in the digital world | Michele Tantussi\/Getty Images<\/p>\n<p>Antitrust experts say that the Android case holds many similarities to a previous EU investigation into Microsoft and its once dominant desktop web browser. That case eventually <a href=\"https:\/\/www.bbc.co.uk\/news\/technology-21684329\" rel=\"noreferrer\" target=\"_blank\">led to more than a billion euros in fines<\/a> and other penalties against the company, as well as demands that it open up the browser market to greater competition. Google claims the cases are different because Android is free to use, while Microsoft charged for Windows.<\/p>\n<p>\u201cThe problem for Google is the conditions that it puts on using Android,\u201d said Damien Geradin, a partner with Euclid Law, a law firm in Brussels that previously worked with Microsoft during its antitrust dealings with the EU. \u201cGoogle says that Android is open source, but thats just not the case.\u201d<\/p>\n<h3><strong>Dominance debate<\/strong><\/h3>\n<p>By slapping Google with a record fine, Vestager is building on a yearslong investigation by the Commission into the search giants place in the <a href=\"https:\/\/www.politico.eu\/article\/google-android-antitrust-europe-margrethe-vestager\/\" rel=\"noreferrer\" target=\"_blank\">ever-evolving digital world<\/a>.<\/p>\n<p>EU antitrust officials are also investigating whether the companys <a href=\"https:\/\/www.politico.eu\/article\/google-adsense-margrethe-vestager-strikes-again\/\" rel=\"noreferrer\" target=\"_blank\">advertising products<\/a> restrict consumer choice, and Vestager said on Wednesday that she has yet to determine if Google is complying with previous charges that it misuses its position in some online search services. The company denies wrongdoing in all cases.<\/p>\n<p>Europes competition czar has repeatedly claimed the investigations are not unfairly targeting U.S. tech firms in order to level the playing field for European rivals. But Vestagers critics have been quick to focus on how the Danish politician has slapped several of Silicon Valleys largest names with sizable fines despite European firms also feeling the brunt of her regulatory powers.<\/p>\n<blockquote>\n<p>The timing of the Android announcement had been complicated because of Trumps visit to Brussels last week to attend a NATO summit.<\/p>\n<\/blockquote>\n<p>\u201cI very much like the U.S.,\u201d Vestager said Wednesday.<\/p>\n<p>Along with the levies against Google, Brussels also <a href=\"https:\/\/www.politico.eu\/article\/margrethe-vestager-slams-apple-with-e13-billion-tax-bill\/\" rel=\"noreferrer\" target=\"_blank\">has ordered<\/a> Apple to repay \u20ac13 billion ($15 billion) in back taxes to the Irish government and <a href=\"https:\/\/www.politico.eu\/article\/facebook-fined-e110-million-for-whatsapp-merger-misstep\/\" rel=\"noreferrer\" target=\"_blank\">fined Facebook<\/a> \u20ac110 million ($129 million) for misleading antitrust officials. The iPhone maker and Dublin are appealing the tax decision.<\/p>\n<p>The friction between the Commission and some of the largest U.S. tech names comes as tensions also build between Brussels and Washington over an escalating trade war. In <a href=\"https:\/\/www.cbsnews.com\/news\/donald-trump-interview-cbs-news-european-union-is-a-foe-ahead-of-putin-meeting-in-helsinki-jeff-glor\/\" rel=\"noreferrer\" target=\"_blank\">an interview<\/a> with CBS Evening News released on Sunday, President Donald Trump said that the European Union <a href=\"https:\/\/www.politico.eu\/article\/donald-trump-putin-russia-europe-one-of-united-states-biggest-foes\/\" rel=\"noreferrer\" target=\"_blank\">is one of the United States biggest foes<\/a>.<\/p>\n<p>The timing of the Android announcement had been complicated because of Trumps visit to Brussels last week to attend a NATO summit, according to a person with knowledge of the matter, who spoke on the condition of anonymity.<\/p>\n<h3><strong>Winners and l<\/strong><strong>osers<\/strong><\/h3>\n<p>In the build-up to Wednesdays decision, rival camps have taken sides depending on their views of Googles position in the digital world.<\/p>\n<p>Groups that favor greater regulation for some of Silicon Valleys biggest names welcomed the record fine, and urged Vestager to go further in her efforts to rein in the perceived excess. Several of the complaints in Europes Android case, including FairSearch, a <a href=\"https:\/\/www.politico.eu\/article\/oracle-naspers-fairsearch-google-lobbying-europe-antitrust-android-competition-margrethe-vestager\/\" rel=\"noreferrer\" target=\"_blank\">group of tech companies<\/a> that includes Oracle and Naspers, a South African e-commerce giant, praised the Commissions actions.<\/p>\n<p>European politicians, notably Bruno Le Maire, Frances finance minister, similarly backed the antitrust fine, while several U.S. consumer groups similarly called for greater scrutiny on some of the tech industrys largest companies.<\/p>\n<blockquote>\n<p>Many app developers claim Google has created an ecosystem that makes it easy for even the smallest of companies to build services that can reach a global audience.<\/p>\n<\/blockquote>\n<p>\u201cIt would be great if she pursued structural solutions,\u201d said Sandeep Vaheesan, policy counsel at the Open Markets Institute in Washington, in reference to efforts to break up firms likes Google and Facebook. \u201cThat would involve less need for constant controls and checks.<\/p>\n<p>Not everyone, though, backed Europes latest push against Google.<\/p>\n<p>Many app developers, in Europe and farther afield, took to social media Wednesday to voice their displeasure about the fine under the hashtag #Androidworks.
