{"id":78228,"date":"2018-05-16T14:06:40","date_gmt":"2018-05-16T14:06:40","guid":{"rendered":"http:\/\/www.bnreport.com\/bhp-billiton-faces-shareholder-class-action-over-brazil-mine-disaster\/"},"modified":"2018-05-16T14:06:40","modified_gmt":"2018-05-16T14:06:40","slug":"bhp-billiton-faces-shareholder-class-action-over-brazil-mine-disaster","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/bhp-billiton-faces-shareholder-class-action-over-brazil-mine-disaster\/","title":{"rendered":"BHP Billiton faces shareholder class action over Brazil mine disaster"},"content":{"rendered":"<p><img decoding=\"async\" src=\"http:\/\/www.cityam.com\/assets\/uploads\/main-image\/full_width_article_body_image\/56850926-5afc1bd24e4c6.jpg\"\/><\/p>\n<p>Mining giant <a href=\"http:\/\/www.cityam.com\/company\/bhp-billiton\" rel=\"noreferrer\" target=\"_blank\">BHP Billiton<\/a> is facing the prospect of a shareholder class action over the collapse of a dam at a mine in Brazil that killed 19 people.<\/p>\n<p>The miner, which is dual-listed on the <a href=\"http:\/\/www.cityam.com\/ftse-100\" rel=\"noreferrer\" target=\"_blank\">FTSE 100<\/a> and the Australian Stock Exchange (ASX) with a secondary listing on the Johannesburg Stock Exchange (JSE), operated the mine in a joint venture with Brazilian miner Vale.<\/p>\n<p>Australian claimant law firm Phi Finney McDonald has said it is preparing to launch a shareholder class action over the disaster.<\/p>\n<p><strong>Read more<\/strong>: <a href=\"http:\/\/www.cityam.com\/228161\/bhp-billiton-concerned-after-samarco-dam-collapse\" rel=\"noreferrer\" target=\"_blank\">At least 17 people killed after BHP Billiton-owned dam bursts<\/a><\/p>\n<p>The firm alleges BHP \u201cbreached its continuous disclosure obligations and engaged in misleading or deceptive conduct\u201d over the safety of the mine.<\/p>\n<p>The 2015 collapse released 60m cubic metres of waste waster, flooding the village of Bento Rodrigues and killing 19 people.<\/p>\n<p>The firm said the disaster had a significant financial impact on BHP and caused a substantial loss of shareholder value.<\/p>\n<p><strong>Read more<\/strong>: <a href=\"http:\/\/www.cityam.com\/267610\/bhp-billiton-share-price-dips-approves-250m-payout-over\" rel=\"noreferrer\" target=\"_blank\">BHP Billiton approves $250m payout over Samarco disaster<\/a><\/p>\n<p>Brett Spiegel, principal lawyer at Phi Finney McDonald said: \u201cConditions at the Fundao dam deteriorated to the point that BHP knew of the imminent risk that the dam would collapse. We allege that the company was also aware of the serious human, environmental, and financial consequences that would result.
