{"id":70865,"date":"2018-03-31T17:15:47","date_gmt":"2018-03-31T17:15:47","guid":{"rendered":"http:\/\/www.bnreport.com\/uk-to-present-new-brexit-backstop-plan-on-ireland-4\/"},"modified":"2018-03-31T17:15:47","modified_gmt":"2018-03-31T17:15:47","slug":"uk-to-present-new-brexit-backstop-plan-on-ireland-4","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/uk-to-present-new-brexit-backstop-plan-on-ireland-4\/","title":{"rendered":"UK to present new Brexit backstop plan on Ireland"},"content":{"rendered":"<p>U.K. Brexit negotiators are developing a plan to solve the Irish border issue by keeping the whole of the U.K. aligned with a subset of the EUs single market rules, according to British officials.<\/p>\n<p>The proposal \u2014 which also involves a wholly new U.K.-EU customs arrangement \u2014 aims to break the deadlock over the border question as both sides embark on a four-week push to rewrite the EUs contentious \u201cbackstop\u201d plan for avoiding a hard Irish border.<\/p>\n<p>A team of officials, including some from the U.K. customs authority, Her Majestys Revenue and Customs, is coming to Brussels on Monday for the discussions, under the overall leadership of the U.K.s chief Brexit official Olly Robbins.<\/p>\n<p>Finding a solution that is acceptable to both sides \u2014 and to the Democratic Unionist Party, whose MPs Theresa May relies on in Westminster to keep her government in power \u2014 is key to forging a successful withdrawal agreement and avoiding a no-deal Brexit. Officials believe the plan being worked on in Whitehall could negate the need for border checks, without separating Northern Ireland from the rest of the U.K.s internal market.<\/p>\n<p>Negotiators are striving for a deal on the terms of the Brexit divorce in time for the European Council summit in June before a final agreement in October that can then be ratified by the U.K. and European parliaments.<\/p>\n<blockquote>\n<p>There is concern that the proposal will be blocked by the European Commission who may view it as a form of \u201ccherry-picking.\u201d<\/p>\n<\/blockquote>\n<p>According to the U.K. officials, who spoke on condition of anonymity, the British proposal is for U.K.-wide \u201cfull alignment\u201d single market rules and regulations for trade in goods \u2014 alongside a new customs arrangement between the U.K. and EU.<\/p>\n<p>While the Irish government itself is open to the proposal, according to U.K. and EU negotiators, there is concern that it will be blocked by the European Commission, which may view it as a form of \u201ccherry-picking,\u201d using Ireland as a lever to win concessions on trade for the whole of the U.K.<\/p>\n<p><strong>Workable solutions<\/strong><\/p>\n<p>May told her fellow EU leaders at the <a href=\"https:\/\/www.politico.eu\/article\/eu-summit-live-blog-trade-tax-brexit-salisbury-attack\/\" rel=\"noreferrer\" target=\"_blank\">European Council summit<\/a> that a<a href=\"https:\/\/www.politico.eu\/article\/eu-and-uk-reach-brexit-transition-deal\/\" rel=\"noreferrer\" target=\"_blank\"> transition deal struck earlier in the week<\/a> could \u201ccreate a new dynamic\u201d in the Brexit talks, and she pledged to \u201cexplore workable solutions\u201d on the Ireland question.<\/p>\n<p>The U.K. has argued from the start that the key to avoiding a hard border will be found in the \u201cdeep and comprehensive free-trade agreement,\u201d which London and Brussels hope to strike sometime during the transition period after Britain has left the bloc. However, the U.K. has accepted that to first get a withdrawal agreement, it will need to sign up to a legally binding \u201cbackstop\u201d clause to act as a guarantee that there will be no hard border even if a solution cannot be found via the proposed free-trade deal.<\/p>\n<p>While British negotiators now accept the need for a backstop solution in the withdrawal agreement, they want a fundamentally different text, a U.K. official said.<\/p>\n<p>Dublin appears willing to go along. Speaking as he arrived at the summit on Friday, the Irish Prime Minister Leo Varadkar said that the British accepted the backstop, \u201cor at least <em>a<\/em> backstop\u201d has to be in the withdrawal agreement.<\/p>\n<p>\u201cIt can be changed really only in one way that I can see, which is moving towards \u2026 a really close trading relationship between the U.K. and the EU,\u201d he said, suggesting a \u201creally deep free-trade agreement\u201d and \u201ca customs union partnership that would be so close to the customs union that it wouldnt necessitate some of the elements of the backstop\u201d as possible viable models.<\/p>\n<p><strong>Full alignment<\/strong><\/p>\n<p>The outline of the potential agreement dates back to December, when the U.K. agreed, as one of the options on Ireland, to \u201cmaintain full alignment\u201d for Northern Ireland with the rules of the EUs single market and customs union in some sectors.<\/p>\n<p>The European Commission has since translated this commitment into<a href=\"https:\/\/ec.europa.eu\/commission\/sites\/beta-political\/files\/draft_agreement_coloured.pdf\" rel=\"noreferrer\" target=\"_blank\"> legal text<\/a> \u2014 the backstop \u2014 proposing a new \u201ccommon regulatory area\u201d between the EU and Northern Ireland to ensure the \u201cfree movement of goods\u201d across the border with the Republic after Brexit. Northern Ireland will also be considered \u201cpart of the customs territory of the Union,\u201d according to the draft legal text.<\/p>\n<p>The proposal was <a href=\"https:\/\/www.politico.eu\/article\/michel-barnier-attempts-to-jolt-uk-into-brexit-action\/\" rel=\"noreferrer\" target=\"_blank\">dismissed out of hand<\/a> by Theresa May, who said \u201cno U.K. prime minister\u201d could ever agree to implement such a proposal, which was seen as effectively creating a customs and trade barrier within the U.K. \u2014 between Northern Ireland and the rest of the country.<\/p>\n<p>U.K. officials in private say the proposal will have to be rewritten or replaced wholesale. But they also say it is not quite as stark as first portrayed, arguing that the Commissions opening position was actually that Northern Ireland should remain in \u201ca limited subset of the single market\u201d \u2014 following rules that pertain to the Good Friday peace agreement, the all-island economy and the north-south cooperation \u2014 not the full single market.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2018\/01\/h_54014039-714x475.jpg\"\/><\/p>\n<p>U.K. Brexit Secretary David Davis | Andy Rain\/EPA<\/p>\n<p>It was also unclear whether this new \u201ccommon regulatory area\u201d necessarily means the single market and all its rules, or whether it could mean two distinct economies with \u201cequivalent\u201d regulations for the sake of cross-border trade. If the latter, U.K. officials hope, the EU may accept the scope of its initial offer being extended to the whole of the U.K. and not just Northern Ireland.<\/p>\n<p>The key issues for debate, according to one senior U.K. official, is how the two sides can deliver \u201cfull alignment\u201d and what the territorial scope of that commitment will be \u2014 the U.K. or Northern Ireland.<\/p>\n<p>The starting point of the U.K.s position will be that \u201cfull alignment\u201d should apply to goods and a limited number of services sectors, one U.K. official said.<\/p>\n<p><strong>Customs conundrum<\/strong><\/p>\n<p>On the customs issue, the proposal that Northern Ireland is subsumed into the EUs customs territory is a non-starter with London, and U.K. negotiators will push for this clause to be scrapped and replaced.<\/p>\n<p>The alternative would be based on one of the two customs arrangements set out by the government <a href=\"https:\/\/www.politico.eu\/article\/uk-sets-out-brexit-customs-plan\/\" rel=\"noreferrer\" target=\"_blank\">in August last year<\/a> and reaffirmed by May in her Mansion House speech. They are either a customs partnership \u2014 known as the \u201chybrid\u201d model internally \u2014 or the \u201chighly streamlined customs arrangement\u201d known by officials as \u201cmax-fac\u201d or maximum facilitation.<\/p>\n<blockquote>\n<p>The complexity and unprecedented nature of this solution has led to accusations from the Brussels side that it amounts to \u201cmagical thinking.\u201d<\/p>\n<\/blockquote>\n<p>The hybrid model would mean the U.K. continuing to police its border as if it were the EUs customs border, but then tracking imports to apply different tariffs depending on which market they end up in \u2014 U.K. or EU. Under this scenario, because Northern Ireland and the Republic of Ireland would share an external EU customs border, as they do now, it would remove the need for checks on the land border between the two.<\/p>\n<p>The complexity and unprecedented nature of this solution has led to accusations from the Brussels side that it amounts to \u201c<a href=\"https:\/\/www.theguardian.com\/uk-news\/2017\/aug\/25\/uk-accused-of-magical-thinking-over-brexit-plan-for-irish-border\" rel=\"noreferrer\" target=\"_blank\">magical thinking<\/a>.\u201d<\/p>\n<p>The \u201cmax-fac\u201d model is simpler conceptually but would represent a huge logistical effort for U.K. customs authorities.
