Can this group fix it?"},"content":{"rendered":"<p>LONDON \u2014 Paul Fehlinger isn\u2019t a household name like Mark Zuckerberg. But the Paris-based policy wonk has an ambition that\u2019s just as big and far-reaching as the Facebook chief\u2019s digital empire: fixing the internet.<\/p>\n<p>With billions of people surfing the web each day \u2014 and tech giants like Google and Facebook now the among the world\u2019s most valuable and well-known companies \u2014 it\u2019s easy to think that nothing needs repairing.<\/p>\n<p>But over the past year, governments from Berlin to Washington to Beijing have <a href=\"https:\/\/www.politico.eu\/article\/internet-governance-facebook-google-splinternet-europe-net-neutrality-data-protection-privacy-united-states-u-s\/\" rel=\"noreferrer\" target=\"_blank\">pushed aggressively<\/a> to reaffirm their dominance over the borderless internet. Think Germany\u2019s <a href=\"https:\/\/www.politico.eu\/article\/germany-hate-speech-netzdg-facebook-youtube-google-twitter-free-speech\/\" rel=\"noreferrer\" target=\"_blank\">new hate speech laws<\/a> with fines of up to \u20ac50 million; the U.S. <a href=\"https:\/\/www.politico.com\/story\/2017\/12\/14\/fcc-votes-to-repeal-net-neutrality-rules-295500\" rel=\"noreferrer\" target=\"_blank\">repeal<\/a> of its net neutrality laws; or China\u2019s ever-expanding \u201c<a href=\"https:\/\/en.wikipedia.org\/wiki\/Great_Firewall\" rel=\"noreferrer\" target=\"_blank\">Great Firewall<\/a>.\u201d<\/p>\n<p>That digital power grab is increasingly dividing the digital world along national or regional borders.<\/p>\n<p>In a sense, the world wide web as we know it is over. And in its place is something altogether different: a Balkanized \u201csplinternet.\u201d<\/p>\n<blockquote>\n<p>\u201cWe need a new generation of laws to govern a new generation of tech\u201d <em>\u2014 Brad Smith, chief legal officer at Microsoft<\/em><\/p>\n<\/blockquote>\n<p>That\u2019s where Fehlinger \u2014 co-founder of the <a href=\"https:\/\/www.internetjurisdiction.net\/\" rel=\"noreferrer\" target=\"_blank\">Internet &amp; Jurisdiction Policy Network<\/a>, a global group of governments, companies and other nonprofit organizations that wants to glue these diverging online worlds back together \u2014 comes in.<\/p>\n<p>His organization has gathered more than 200 global lawmakers, corporate executives and members of civil society for a <a href=\"https:\/\/conference.internetjurisdiction.net\/\" rel=\"noreferrer\" target=\"_blank\">three-day conference<\/a> in Ottawa, Canada this week to figure out how to set global rules for the internet.<\/p>\n<p>\u201cIt\u2019s one of the most difficult global governance challenges of the 21st century,\u201d said Fehlinger, who has invited lawmakers from Europe, the United States and elsewhere as well as senior officials from Google, Amazon and Facebook.<\/p>\n<p>\u201cThere\u2019s a paradigm shift going on. Governments are moving from a position of non-interference to a realization that if we want to keep a cross-border internet going, then we need a new system of governance,\u201d he added.<!--more--><\/p>\n<p> <img decoding=\"async\" src=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2017\/07\/GettyImages-452918822article-714x475.jpg\"\/><\/p>\n<p>Data servers in Pantin, a suburb north of Paris in the Seine-Saint-Denis department | Martin Bureau\/AFP via Getty Images<\/p>\n<p>Agreeing on a global rulebook for the web is easier said than done.<\/p>\n<p>From Brazil to Indonesia to France, states are staking out huge swaths of the digital world. The EU is doing its share by <a href=\"https:\/\/www.politico.eu\/article\/europe-data-protection-privacy-standards-gdpr-general-protection-data-regulation\/\" rel=\"noreferrer\" target=\"_blank\">exporting tough privacy rules<\/a> globally. Authoritarian regimes like Turkey and Russia are doing theirs by <a href=\"http:\/\/www.bbc.com\/news\/technology-43070555\" rel=\"noreferrer\" target=\"_blank\">censoring<\/a> people\u2019s activities on social networks. Meanwhile, emerging economies like Kenya are struggling to decide whether to follow an open or closed internet rulebook just as many of their citizens join the digital era.<\/p>\n<p>For those gathering in Ottawa, the trend of increasing state intervention poses a maddeningly tough question: How can national governments apply their own legitimate national (yet often conflicting) rules to the web without undermining the inherent global nature of the internet?<\/p>\n<p>\u201cIt\u2019s incredibly difficult,\u201d said Oscar Gonzalez, <a href=\"https:\/\/www.linkedin.com\/in\/oscar-gonzalez-08643276\/\" rel=\"noreferrer\" target=\"_blank\">undersecretary of regulation<\/a> at Argentina\u2019s modernization ministry. \u201cThe internet has challenged the institutions that we have in place. The issue of countries\u2019 sovereign jurisdiction is at stake.\u201d<\/p>\n<p>Gonzalez and the rest of the attendees at the Ottawa conference know that devising a U.N.-style governance system for the internet age will be not be easy, especially given that no one from China, the <a href=\"https:\/\/www.mckinsey.com\/global-themes\/china\/chinas-digital-economy-a-leading-global-force\" rel=\"noreferrer\" target=\"_blank\">world\u2019s largest digital economy<\/a>, will participate.<\/p>\n<p>So they are limiting their discussions in scope.<\/p>\n<p>Much of the conference this week will focus on hammering out a global deal on how to regulate online content like YouTube videos, Facebook posts and Twitter messages. That debate has become increasingly politicized because of the <a href=\"https:\/\/www.politico.com\/story\/2018\/02\/16\/mueller-indictment-russia-florida-interference-416255\" rel=\"noreferrer\" target=\"_blank\">alleged Russian interference<\/a> in many elections worldwide over the last 18 months, as well as the <a href=\"https:\/\/www.politico.eu\/article\/europe-hate-speech-jihad-terrorist-propaganda-theresa-may-google-facebook\/\" rel=\"noreferrer\" target=\"_blank\">rise of extremist and other hate speech<\/a> on many social networks.<\/p>\n<blockquote>\n<p>\u201cThere\u2019s no global consensus about the best way to enable the governance of content online\u201d \u2014 <em> Emma Llans\u00f3, director of the free expression project at the Center for Democracy and Technology<\/em><\/p>\n<\/blockquote>\n<p>Several participants attending the Ottawa meeting said they did not aim to create a one-size-fits-all approach to online content, which would be impossible because of countries\u2019 diverging stances on free speech and what constitutes illegal material.<\/p>\n<p>Instead, they want to figure out how national governments can extend their own laws over such digital material within their borders, while respecting the rights of other countries that hold different views on regulating the same content.<\/p>\n<p>That may sound like an unwieldy fudge. But it would be a step forward from the current global online land grab where countries are racing to apply their own rules worldwide before other nations\u2019 politicians can beat them to it.<\/p>\n<p>\u201cI don\u2019t know if we\u2019ll see a new treaty in the next three to five years to solve all these problems at once,\u201d said Emma Llans\u00f3, director of the free expression project at the Center for Democracy and Technology, a think tank in Washington. \u201cThere\u2019s no global consensus about the best way to enable the governance of content online.\u201d<\/p>\n<p>Another major challenge for Ottawa: how to keep digital data flowing worldwide at a time when Europe and the United States \u2014 the Western world\u2019s two largest markets \u2014 <a href=\"https:\/\/www.politico.eu\/tag\/eu-u-s-privacy-shield\/\" rel=\"noreferrer\" target=\"_blank\">remain at loggerheads<\/a> over who can collect, manage and use such information (everything from search queries to corporate payroll information).<\/p>\n<p> <img decoding=\"async\" src=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2018\/02\/GettyImages-459794516-714x520.jpg\"\/><\/p>\n<p>Commuters consult their electronic connected devices inside a train coach in the Moscow metro | Dmitry Serebryakov\/AFP via Getty Images<\/p>\n<p>This isn\u2019t just a question of making sure <a href=\"https:\/\/www.youtube.com\/watch?v=5dsGWM5XGdg\" rel=\"noreferrer\" target=\"_blank\">online videos of cute cats<\/a> aren\u2019t turned off overnight. The digital economy now represents hundreds of billions of euros of annual global trade. And if countries start putting up digital barriers, it\u2019s likely \u2014 if not inevitable \u2014 that such trade will take a hit.<\/p>\n<p>To keep global data flows moving, it\u2019s essential to find a balance between national law enforcements\u2019 need to access such information to thwart crimes and privacy campaigners\u2019 demands that people\u2019s information is not misused, either by government agencies or private companies. That debate has even made it to the U.S. Supreme Court, where judges will hold a hearing Tuesday to determine if the U.S. government has the right to unilaterally obtain online information held overseas.<\/p>\n<p>\u201cWe need a new generation of laws to govern a new generation of tech,\u201d said Brad Smith, chief legal officer at Microsoft, which <a href=\"https:\/\/www.politico.com\/story\/2017\/10\/16\/supreme-court-microsoft-us-data-243809\" rel=\"noreferrer\" target=\"_blank\">is embroiled<\/a> in the Supreme Court case. \u201cThe only way to reconcile the tension between national sovereignty issues is to move faster towards international regulation.\u201d<\/p>\n<p>That last point \u2014 moving faster toward international regulation \u2014 cannot be understated.<\/p>\n<p>The Ottawa conference will certainly move the ball forward on creating global digital rules. Fehlinger and his organization are planning another meeting next year in Berlin.<\/p>\n<p>But it\u2019s painstaking work. And these negotiations, even if they are successful, will likely take years.<\/p>\n<p>With the current fracturing of the internet into Balkanized regional fiefdoms, any effort to bring the digital world back together should be welcomed.
