{"id":57072,"date":"2018-01-08T20:01:30","date_gmt":"2018-01-08T20:01:30","guid":{"rendered":"http:\/\/www.bnreport.com\/net-neutrality-gaining-steam-in-state-legislatures-after-fcc-repeal\/"},"modified":"2018-01-08T20:01:30","modified_gmt":"2018-01-08T20:01:30","slug":"net-neutrality-gaining-steam-in-state-legislatures-after-fcc-repeal","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/net-neutrality-gaining-steam-in-state-legislatures-after-fcc-repeal\/","title":{"rendered":"Net neutrality gaining steam in state legislatures after FCC repeal"},"content":{"rendered":"<figure><figcaption><a href=\"https:\/\/cdn.arstechnica.net\/wp-content\/uploads\/2018\/01\/getty-net-neutrality.jpg\" rel=\"noreferrer\" target=\"_blank\">Enlarge<\/a>Getty Images | wildpixel<\/figcaption><\/figure>\n<p>State legislators in Nebraska and California are proposing net neutrality laws to replace the US-wide ones repealed by the Federal Communications Commission.<\/p>\n<p>The FCC <a href=\"https:\/\/arstechnica.com\/tech-policy\/2017\/12\/goodbye-net-neutrality-ajit-pais-fcc-votes-to-allow-blocking-and-throttling\/\" rel=\"noreferrer\" target=\"_blank\">repealed<\/a> its own net neutrality rules <em>and<\/em><a href=\"https:\/\/arstechnica.com\/tech-policy\/2017\/11\/fcc-will-also-order-states-to-scrap-plans-for-their-own-net-neutrality-laws\/\" rel=\"noreferrer\" target=\"_blank\">claims the authority<\/a> to prevent state and local governments from enacting their own similar net neutrality rules. <\/p>\n<p>But a <a href=\"https:\/\/nebraskalegislature.gov\/FloorDocs\/105\/PDF\/Intro\/LB856.pdf\" rel=\"noreferrer\" target=\"_blank\">Nebraska bill<\/a>, introduced by Democratic Sen. Adam Morfeld of Lincoln, would do just that.<\/p>\n<p>&quot;No Internet service provider engaged in the provision of fixed or mobile broadband Internet access service shall impair or degrade lawful Internet traffic on the basis of content, application, or service or use of a nonharmful device, subject to reasonable network management,&quot; the bill says.<\/p>\n<p>The proposal would also ban paid prioritization, which it defines as directly or indirectly &quot;favor[ing] some traffic over other traffic, including through use of techniques such as traffic shaping, prioritization, resource reservation, or other forms of preferential traffic management, either in exchange for monetary or other consideration from a third party or to benefit an affiliated entity.&quot; Paid prioritization would be allowed only when an ISP can demonstrate that it benefits the public and &quot;would not harm the open nature&quot; of its Internet service.<\/p>\n<h2>Bipartisan support<\/h2>\n<p>Morfeld said he has been surprised by the bipartisan support he&#039;s received so far. &quot;I knew I was passionate about it, but I was shocked at the support I received from Republicans, from Democrats and Libertarians,&quot; he said, <a href=\"http:\/\/journalstar.com\/legislature\/internet-drives-the-economy-now-lincoln-senator-seeks-to-re\/article_8ca09b18-9f0d-5a18-8297-90fbb75ad7da.html\" rel=\"noreferrer\" target=\"_blank\">according to<\/a> the <em>Lincoln Journal Star<\/em>.<\/p>\n<p>While net neutrality is often a politically divisive issue in government, <a href=\"http:\/\/thehill.com\/policy\/technology\/341850-poll-gop-voters-support-net-neutrality-rules-oppose-att-time-warner-merger\" rel=\"noreferrer\" target=\"_blank\">polls<\/a> show that <a href=\"http:\/\/www.slate.com\/blogs\/future_tense\/2017\/06\/08\/survey_suggests_americans_are_big_fans_of_net_neutrality.html\" rel=\"noreferrer\" target=\"_blank\">majorities<\/a> of both <a href=\"https:\/\/www.washingtonpost.com\/news\/the-switch\/wp\/2017\/12\/12\/this-poll-gave-americans-a-detailed-case-for-and-against-the-fccs-net-neutrality-plan-the-reaction-among-republicans-was-striking\/\" rel=\"noreferrer\" target=\"_blank\">Democratic and Republican voters<\/a> support net neutrality rules.<\/p>\n<p>Attorneys general from New York and other states <a href=\"https:\/\/arstechnica.com\/tech-policy\/2017\/12\/state-attorneys-general-line-up-to-sue-fcc-over-net-neutrality-repeal\/\" rel=\"noreferrer\" target=\"_blank\">plan to sue<\/a> the FCC to reverse the repeal of federal net neutrality rules and the preemption of local net neutrality rules. But in case the lawsuit fails, legislators in some states are crafting net neutrality bills in ways <a href=\"https:\/\/arstechnica.com\/tech-policy\/2017\/12\/new-york-tried-end-run-around-fcc-preemption-with-net-neutrality-law\/\" rel=\"noreferrer\" target=\"_blank\">designed to get around<\/a> the FCC&#039;s attempt at preemption.<\/p>\n<p>A <a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201720180SB822\" rel=\"noreferrer\" target=\"_blank\">bill in California<\/a> from Sen. Scott Wiener (D-San Francisco) would indirectly enforce net neutrality. For example, <a href=\"http:\/\/sd11.senate.ca.gov\/news\/20180103-senator-wiener-introduce-net-neutrality-legislation-today-california-legislature\" rel=\"noreferrer\" target=\"_blank\">Wiener&#039;s bill would<\/a> &quot;Require net neutrality as part of cable franchise agreements, as a condition to using the public right-of-way for Internet infrastructure,&quot; and &quot;Condition the right to attach small cell or other broadband wireless communications to utility poles on adherence to net neutrality.&quot;<\/p>\n<p>Wiener&#039;s bill would also &quot;us[e] the state\u2019s market influence as a purchaser of Internet and telecommunications services to effectuate net neutrality&quot; and strengthen consumer protection laws and laws against deceptive and unfair business practice in ways that support net neutrality.<!--more--><\/p>\n<p><a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=201720180SB460\" rel=\"noreferrer\" target=\"_blank\">Another California bill<\/a> from Sen. Kevin de Le\u00f3n (D-Los Angeles) takes a more direct approach by simply banning blocking, throttling, and paid prioritization.<\/p>\n<p>In New York, one legislative proposal would require state agencies and local governments to do business only with ISPs that adhere to net neutrality principles, as we <a href=\"https:\/\/arstechnica.com\/tech-policy\/2017\/12\/new-york-tried-end-run-around-fcc-preemption-with-net-neutrality-law\/\" rel=\"noreferrer\" target=\"_blank\">previously reported<\/a>. There&#039;s also a net neutrality bill being considered in the <a href=\"http:\/\/lawfilesext.leg.wa.gov\/biennium\/2017-18\/Pdf\/Bills\/House%20Bills\/2282.pdf\" rel=\"noreferrer\" target=\"_blank\">Washington<\/a> state legislature.<\/p>\n<p>The FCC <a href=\"https:\/\/arstechnica.com\/tech-policy\/2018\/01\/fcc-releases-final-net-neutrality-repeal-order-three-weeks-after-vote\/\" rel=\"noreferrer\" target=\"_blank\">released<\/a> the final text of its net neutrality repeal on Thursday, setting the stage for lawsuits against the FCC.
