{"id":151594,"date":"2020-09-28T22:20:13","date_gmt":"2020-09-28T22:20:13","guid":{"rendered":"https:\/\/www.bnreport.com\/brexit-brinksmanship-on-medicines-risks-lives-meps-warn\/"},"modified":"2020-09-28T22:20:13","modified_gmt":"2020-09-28T22:20:13","slug":"brexit-brinksmanship-on-medicines-risks-lives-meps-warn","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/brexit-brinksmanship-on-medicines-risks-lives-meps-warn\/","title":{"rendered":"Brexit brinksmanship on medicines risks lives, MEPs warn"},"content":{"rendered":"<p>The U.K. pharmaceutical industry is facing a nightmare scenario \u2014 the looming possibility of no trade deal with the EU resulting in a disruption to the movement of medicines amid an ongoing pandemic.<\/p>\n<p>Once again the industry is being forced into frantic no-deal preparations \u00e0 la 2019, with unanswered questions on issues such as the status of Northern Ireland and the future of medicines regulation in the U.K. To top off the confusion, the recent <a href=\"https:\/\/www.politico.eu\/article\/uks-latest-brexit-fight-with-the-eu-explained\/\" rel=\"noreferrer noopener\" target=\"_blank\">controversial Internal Market Bill<\/a> threatens to allow the British government to renege on rules previously agreed with the EU on the movement of goods.<\/p>\n<p>\u201cPeople are now tearing their hair out,\u201d is how MEP Barry Andrews, from Irelands Fianna F\u00e1il party, described it.<\/p>\n<p>\u201cIt was bad enough worrying about no deal \u2026 [and] how the Northern Ireland protocol would work,\u201d he said. \u201cBut now \u2026 its how the Northern Ireland protocol is going to work if its dis-applied and there is no deal.\u201d<\/p>\n<p>\u201cIts just the perfect storm,\u201d he added. \u201cUnfortunately, peoples lives are at risk.\u201d<\/p>\n<h3>Once more, with feeling<\/h3>\n<p>Possibly most pressing is the lack of answers on Northern Ireland.<\/p>\n<p>Northern Ireland mainly receives its medical supplies via ferry from Great Britain. It also has its own, but relatively small, life sciences industry that produces about <a href=\"https:\/\/globalambition.ie\/wp-content\/uploads\/2020\/03\/Enterprise-Ireland-Report-UK-Pharmaceutical-Manufacturing-Sector-Overview.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">2 percent of the U.K.s pharmaceutical output<\/a>.<\/p>\n<p>While the U.K.s Medicines and Healthcare products Regulatory Agency (MHRA) has published <a href=\"https:\/\/www.gov.uk\/government\/collections\/mhra-post-transition-period-information\" rel=\"noreferrer noopener\" target=\"_blank\">guidance<\/a> on what will happen for many medicines and medical devices come January 1, the Association of the British Pharmaceutical Industry has <a href=\"https:\/\/www.abpi.org.uk\/media-centre\/news\/2020\/september\/abpi-response-to-mhra-guidance-for-the-end-of-the-transition-period\/\" rel=\"noreferrer noopener\" target=\"_blank\">said<\/a> that companies are \u201cstill waiting for detailed guidance on the regulation of medicines in Northern Ireland.\u201d<\/p>\n<p>Under the Withdrawal Agreement, Northern Ireland sits in a strange position. Its part of the U.K. but obliged to comply with EU customs rules and product standards.<\/p>\n<p>As things currently stand, on January 1, the MHRA will be responsible for regulating medicines in Northern Ireland, explained Maree Gallagher, an Irish and EU life sciences lawyer at Covington &amp; Burling. However, medicines moving from Great Britain into Northern Ireland (or indeed, from the Republic of Ireland into Northern Ireland), need to comply with EU drug rules. And if a medicine is approved by the EU, this approval will also apply to Northern Ireland.<\/p>\n<p>\u201cOur interpretation is that all medicines placed on the market in Northern Ireland will be required to comply with EU medicines law and any additional U.K. requirements that might apply,\u201d she said.<\/p>\n<p>The upshot, said Tammy Hervey, professor of European Union law at the University of Sheffield, is that \u201cthere will need to be checks on compliance with those rules of pharmaceuticals marketed in Northern Ireland.\u201d<\/p>\n<p>While drugs coming from the EU into Northern Ireland will automatically be compliant, those coming from Great Britain \u201ccannot be assumed to be compliant, and so logically will have to be subject to checks.\u201d<\/p>\n<p>\u201cWhat we really dont know is how or where those checks will be carried out,\u201d she said. \u201cWe also dont know where the burden of costs will lie.\u201d<\/p>\n<p>MEP Billy Kelleher, also from Irelands Fianna F\u00e1il party, warned of Northern Ireland falling into \u201ca type of limbo if were not careful.\u201d<\/p>\n<p>Indeed, one of the issues that the EU-U.K. Joint Committee subgroup on the Northern Ireland protocol is meant to decide is what goods are at risk of onward movement from Northern Ireland into the Republic of Ireland. According to MEP Andrews, medicines are \u201cvery much at risk\u201d of moving into the single market.<\/p>\n<blockquote><p>\nAnother possible delay is the lack of a mutual recognition agreement on good manufacturing practice and batch testing of medicines.\n<\/p><\/blockquote>\n<p>That panel is supposed to give \u201cclarity\u201d on that question, which pharma also needs, he explained.<\/p>\n<p>\u201cBut its not available at the moment,\u201d he added.<\/p>\n<p>Stockpiling is also already an issue, he noted. In fact, in August, the government <a href=\"https:\/\/www.gov.uk\/government\/publications\/letter-to-medicines-and-medical-products-suppliers-3-august-2020\/letter-to-medicine-suppliers-3-august-2020\" rel=\"noreferrer noopener\" target=\"_blank\">called for six weeks of medicines stockpiles<\/a> across the whole of the U.K. But companies in Northern Ireland are going further.<\/p>\n<p>\u201cIn practice, we understand that companies are stockpiling six months or more product for the Northern Ireland market,\u201d said Marie Doyle-Rossi, who is also a life sciences lawyer at Covington &amp; Burling. But there isnt enough warehouse space, which \u201cmay mean companies cannot stockpile as much product as they intended,\u201d she added.<\/p>\n<p>In response, a Department of Health and Social Care spokesperson said that the government was \u201cworking closely with the health and care system, suppliers, industry and the Devolved Administrations to put in place robust measures to help ensure the continued supply of medicines and medical products to the whole of the U.K. at the end of the transition period.\u201d<\/p>\n<p>The governments plans were considered alongside seasonal pressures as well as the pandemic, the spokesperson added.<\/p>\n<h3>Fragile supply chains<\/h3>\n<p>Additional border checks could mean that medicines dont reach patients on time, a concern that will be reinforced by the <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/920675\/RWCS_for_our_borders_FINAL.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">governments latest \u201creasonable worst case scenario\u201d<\/a> published September 23. It suggests both imports and exports could be significantly impacted by delays of up to two days due to queues of thousands of trucks at the border in Kent.<\/p>\n<p>Another possible delay is the lack of a mutual recognition agreement on good manufacturing practice and batch testing of medicines.<\/p>\n<p>Without these mutual recognition agreements, authorities may need to conduct checks in the importing country, which in turn could further delay supply chains.
