{"id":151365,"date":"2020-09-13T22:21:04","date_gmt":"2020-09-13T22:21:04","guid":{"rendered":"https:\/\/www.bnreport.com\/6-ways-germany-could-kill-the-nord-stream-2-pipeline\/"},"modified":"2020-09-13T22:21:04","modified_gmt":"2020-09-13T22:21:04","slug":"6-ways-germany-could-kill-the-nord-stream-2-pipeline","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/6-ways-germany-could-kill-the-nord-stream-2-pipeline\/","title":{"rendered":"6 ways Germany could kill the Nord Stream 2 pipeline"},"content":{"rendered":"<p>Theres growing pressure on Germany to rethink its support for the <a href=\"https:\/\/www.politico.eu\/article\/why-germany-cant-say-no-to-nord-stream\/\" rel=\"noreferrer noopener\" target=\"_blank\">Russia-backed Nord Stream 2 pipeline<\/a> project, but that could open Berlin to legal, financial and political problems.<\/p>\n<p>Germany has long argued that the 1,230-kilometer pipeline that is supposed to send an extra 55 billion cubic meters of Russian gas a year under the Baltic Sea is a commercial venture, not a political one.<\/p>\n<p>That position is increasingly under strain in the wake of the poisoning of Russian opposition leader Alexei Navalny.<\/p>\n<p>In a major turnaround, German Chancellor Angela Merkel <a href=\"https:\/\/www.handelsblatt.com\/dpa\/konjunktur\/wirtschaft-handel-und-finanzen-roundup-merkel-noch-kein-abschliessendes-urteil-zu-nord-stream-2\/26168452.html?ticket=ST-713172-9212NjYqB9ppiZTHDokC-ap4\" rel=\"noreferrer noopener\" target=\"_blank\">said<\/a> this week of the possibility of halting the pipeline: \u201cI have not yet formed a final judgment on this.\u201d<\/p>\n<p>But there isnt much Germany alone can do to block the completion of the pipeline without running afoul of EU law or risking multibillion-dollar damage claims by the Nord Stream 2 company \u2014 which is headquartered in Switzerland, but is wholly owned by Russias majority-state-owned Gazprom.<\/p>\n<blockquote><p>\nAt the EU level, it is also unclear whether Germany is allowed to halt gas flows into Europe on its own.\n<\/p><\/blockquote>\n<p>However, Germany could very easily sit back, let others do the dirty work, and watch the unfinished Nord Stream 2 slowly rot in the icy Baltic.<\/p>\n<p>Here are six possible moves \u2014 and their consequences.<\/p>\n<h3>1. Revoke existing pipeline permits<\/h3>\n<p>Two German authorities have so far issued <a href=\"https:\/\/www.nord-stream2.com\/en\/pdf\/document\/184\/\" rel=\"noreferrer noopener\" target=\"_blank\">construction permits<\/a> to Nord Stream 2.<\/p>\n<p>The regional Stralsund Mining Authority \u2014 which approved plans for work in German territorial waters along the continental shelf \u2014 belongs to the fiercely pro-pipeline state of Mecklenburg-Vorpommern.<\/p>\n<p>Thats the same state which is home to (and co-owns) the port of Mukran, which was threatened with \u201c<a href=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2020\/08\/Formal-legal-notice-to-German-Port-of-Mukran.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">crushing<\/a>\u201d U.S. sanctions <a href=\"https:\/\/www.politico.eu\/?p=1429727\" rel=\"noreferrer noopener\" target=\"_blank\">by three Republican U.S. senators<\/a> last month. In response, the state parliament <a href=\"https:\/\/www.karsten-kolbe.de\/nc\/presse\/aktuell\/detail\/news\/ja-zu-nordstream-2-erpressungsversuchen-keine-chance-geben\/\" rel=\"noreferrer noopener\" target=\"_blank\">passed a motion<\/a> affirming its desire to complete Nord Stream 2 and asserting that \u201cblackmail has no place in world trade.\u201d<\/p>\n<p>Manuela Schwesig, the states premier, has also been a <a href=\"https:\/\/twitter.com\/ManuelaSchwesig\/status\/1303223091401756673\" rel=\"noreferrer noopener\" target=\"_blank\">vocal supporter<\/a> of keeping the pipeline separate from international politics.<\/p>\n<p>Getting Mecklenburg-Vorpommern to pull its permits on political grounds would be an uphill battle.<\/p>\n<p>Theres also the Federal Maritime and Hydrographic Agency, which issued permits covering the extended waters of Germanys exclusive economic zone. Its independent of the government, making it tricky if Berlin tried to put pressure on it.<\/p>\n<p>In both cases, pulling permissions for political reasons would create an opening for the Switzerland-based Nord Stream 2 AG to sue Germany under the Energy Charter Treaty, to which both countries are signatories. The treaty is meant to protect investments such as the pipeline from discrimination and ensure approved projects arent jeopardized by unpredictable policy changes.<\/p>\n<p>Damages from such litigation could run as high as the cost of the pipeline itself: about \u20ac9.5 billion. If arbitrators allow lost profits to be included in the calculation, the bill goes up from there.<\/p>\n<h3>2. Watch environmental NGOs challenge the permits in court<\/h3>\n<p>German politicians could also sit back and watch ongoing litigation run its course.<\/p>\n<p>Deutsche Umwelthilfe, an NGO, has <a href=\"https:\/\/www.duh.de\/presse\/pressemitteilungen\/pressemitteilung\/deutsche-umwelthilfe-geht-gerichtlich-gegen-nord-stream-2-vor\/\" rel=\"noreferrer noopener\" target=\"_blank\">sued<\/a> to have the operating permit issued by the Stralsund Mining Authority reviewed on climate grounds. It claims that the environmental impact assessment authorizing the permits should take into account new scientific findings showing that methane leaks contributing to global warming are significantly higher than previously thought. It argues construction should be frozen pending the outcome of a review, and that the project is incompatible with the countrys climate targets.<\/p>\n<p>The mining authority already declined to review this on its own \u2014 but the Greifswald Higher Administrative Court, which is handling the case, could rule otherwise.<\/p>\n<h3>3. Issue a national restriction on Russian gas imports<\/h3>\n<p>Germanys <a href=\"https:\/\/www.gesetze-im-internet.de\/englisch_awg\/index.html\" rel=\"noreferrer noopener\" target=\"_blank\">Foreign Trade and Payments Act<\/a> does allow for restrictions on foreign trade \u201cto guarantee the essential security interests of the Federal Republic of Germany or to prevent a disturbance of the peaceful coexistence of nations.\u201d<\/p>\n<p>The act can also be used in response to danger \u201cpertaining to an individual case\u201d \u2014 potentially the poisoning of Navalny \u2014 but any measures must be proportionate (usually temporary, in six-month increments) and backed with sufficient justification.<\/p>\n<p>This could be used against the Nord Stream 2 pipeline. It could also be wielded against the already-operational first Nord Stream, should Germany want to take a stand by blocking current gas flows without touching Nord Stream 2.<\/p>\n<p>The uncertainty here is twofold.<\/p>\n<blockquote><p>\nWashington is targeting pipe-laying activities, and in December <a href=\"https:\/\/www.politico.eu\/article\/nord-stream-2-russia-sanctions-us-donald-trump\/\" rel=\"noreferrer noopener\" target=\"_blank\">scared<\/a> Swiss-Dutch company Allseas off laying the remaining 150 kilometers to finish the pipeline.\n<\/p><\/blockquote>\n<p>Domestically, a German court could overturn such a ban based on insufficient justification \u2014 or if the measures were deemed to be a disproportionately severe response. Thats what happened in December 2019, when the Frankfurt Administrative Court <a href=\"https:\/\/www.reuters.com\/article\/us-germany-arms-saudi\/german-court-annuls-de-facto-armored-vehicles-export-ban-to-saudi-arabia-idUSKBN1Y71MX\" rel=\"noreferrer noopener\" target=\"_blank\">threw out<\/a> a restriction on armored vehicle sales to Saudi Arabia undertaken in response to the murder of journalist Jamal Khashoggi.<\/p>\n<p>Part of the courts <a href=\"https:\/\/www.handelsblatt.com\/unternehmen\/industrie\/ruestungsexporte-verwaltungsgericht-kippt-ausfuhrverbot-fuer-ruestungsgueter-nach-saudi-arabien\/25296488.html?ticket=ST-1002014-RhYVt077cvPff40DjSF7-ap3\" rel=\"noreferrer noopener\" target=\"_blank\">reasoning<\/a> in that case was that Germanys foreign relations were not sufficiently shown to be threatened, given that other countries had not taken similar action. The repeated extension of the temporary restriction was also questioned under proportionality standards.<\/p>\n<p>While restrictions deemed legitimate dont give rise to compensation claims by affected companies, those ruled illegal would qualify for damages.<\/p>\n<p>At the EU level, it is also unclear whether Germany is allowed to halt gas flows into Europe on its own \u2014 or whether such restrictive action is exclusively reserved for the EU under <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A12016E215\" rel=\"noreferrer noopener\" target=\"_blank\">Article 215 of the Treaty on the Functioning of the European Union<\/a>.<\/p>\n<h3>4.
