{"id":151326,"date":"2020-09-10T22:22:57","date_gmt":"2020-09-10T22:22:57","guid":{"rendered":"https:\/\/www.bnreport.com\/facebook-to-be-forced-to-stop-sending-eu-data-to-the-us\/"},"modified":"2020-09-10T22:22:57","modified_gmt":"2020-09-10T22:22:57","slug":"facebook-to-be-forced-to-stop-sending-eu-data-to-the-us","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/facebook-to-be-forced-to-stop-sending-eu-data-to-the-us\/","title":{"rendered":"Facebook to be forced to stop sending EU data to the US"},"content":{"rendered":"<p>Irelands privacy watchdog has told Facebook that it will soon have to stop transferring its European users data to the United States because the social media giants current procedures fall foul of EU law.<\/p>\n<p>Facebook was told in early August that the Irish privacy regulator was reviewing how it moved data to the U.S., according to two people with knowledge of the case who spoke on the condition of anonymity because they were not authorized to speak publicly.<\/p>\n<p>In a <a href=\"https:\/\/about.fb.com\/news\/2020\/09\/securing-the-long-term-stability-of-cross-border-data-flows\/\" rel=\"noreferrer noopener\" target=\"_blank\">statement<\/a>, Nick Clegg, Facebooks head lobbyist, confirmed Irelands expected decision, saying that the pending ruling would be felt across the transatlantic economy.<\/p>\n<p>\u201cA lack of safe, secure and legal international data transfers would damage the economy and hamper the growth of data-driven businesses in the EU,\u201d Clegg said. \u201cWe will continue to transfer data in compliance with the recent CJEU ruling and until we receive further guidance.\u201d<\/p>\n<p>Facebook still has an opportunity to put its case to Irelands Data Protection Commissioner before a final judgment \u2014 but the order will likely set a precedent for how billions of euros of data should be handled and moved across the Atlantic.<\/p>\n<blockquote><p> Privacy campaigners have long accused the U.S. of mishandling peoples personal data.<\/p>\n<\/blockquote>\n<p>The order may force other tech giants like Google to reconsider transferring EU data to the U.S. after the 27-country blocs highest court <a href=\"https:\/\/www.politico.eu\/?p=1416033\" rel=\"noreferrer noopener\" target=\"_blank\">ruled in July<\/a> that the U.S. did not sufficiently protect Europeans privacy rights when their data was accessed by American national security agencies.<\/p>\n<p>Privacy campaigners have long accused the U.S. of mishandling peoples personal data, and several legal challenges that found their way to Europes highest court confirmed that Washington was not seen as sufficiently protecting EU data protection rights under the blocs tough privacy standards.<\/p>\n<p>\u201cFacebook is knowingly in violation of the law since 2013,\u201d Max Schrems, the privacy campaigner who brought the initial complaint against the company, told POLITICO. \u201cIt seems now not even the DPC can deny that Facebooks international data transfers are built on sand.\u201d<\/p>\n<p>The privacy decision involving Facebook relates to so-called standard contractual clauses, or complex legal mechanisms that allow companies to move data from the EU to other parts of the world.<!--more--><\/p>\n<p>These clauses had come under threat in the July decision from the Court of Justice of the European Union, which stated that companies and national EU privacy agencies were required to review if such data-transfer mechanisms were still legal when countries like the United States did not have sufficient privacy protections in place.<\/p>\n<p>Because Europes highest court had ruled that data transfers to the U.S. were no longer legal, Dublin was eager to push forward with a decision that could be shared with it<a href=\"https:\/\/www.politico.eu\/article\/facebook-privacy-data-us\/?utm_source=RSS_Feed&amp;utm_medium=RSS&amp;utm_campaign=RSS_Syndication\" rel=\"noreferrer noopener\" target=\"_blank\">Read More \u2013 Source<\/a><\/p>\n<p>[contf] [contfnew]         <img decoding=\"async\" src=\"https:\/\/snap.md\/wp-content\/uploads\/2018\/03\/politico-logo.jpg\"\/><\/p>\n<h5><a href=\"https:\/\/www.politico.eu\/\" rel=\"noreferrer noopener\" target=\"_blank\">politico<\/a><\/h5>\n<p>[contfnewc] [contfnewc]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Irelands privacy watchdog has told Facebook that it will soo..<\/p>\n","protected":false},"author":1,"featured_media":151327,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[50],"tags":[],"class_list":["post-151326","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-tech"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.9 -
