{"id":151255,"date":"2020-09-06T22:22:08","date_gmt":"2020-09-06T22:22:08","guid":{"rendered":"https:\/\/www.bnreport.com\/why-europes-hands-are-tied-on-tiktok\/"},"modified":"2020-09-06T22:22:08","modified_gmt":"2020-09-06T22:22:08","slug":"why-europes-hands-are-tied-on-tiktok","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/why-europes-hands-are-tied-on-tiktok\/","title":{"rendered":"Why Europes hands are tied on TikTok"},"content":{"rendered":"<p>TikToks potential breakup in the United States is pushing European regulators to reckon with the Chinese app \u2014 except they cant decide who is in charge.<\/p>\n<p>Despite several open investigations targeting TikTok, legal wrangling over who has direct oversight is paralyzing Europes privacy watchdogs.<\/p>\n<p>The situation highlights the inertia of a system that relies on a complex balance of power between dozens of regulators \u2014 and one lead enforcer \u2014 to apply the worlds strictest privacy rulebook, the GDPR.<\/p>\n<p>It comes as U.S. President Donald Trumps administration piles pressure on the apps Chinese owners to sell off their U.S. business or face a ban.<\/p>\n<p>So far, TikTok has enjoyed much <a href=\"https:\/\/www.politico.eu\/article\/tiktok-europe-safe-haven-us-china-tech-standoff\/\" rel=\"noreferrer noopener\" target=\"_blank\">warmer reception in Europe<\/a>. On Tuesday, European Internal Market Commissioner Thierry Breton <a href=\"https:\/\/www.politico.eu\/article\/breton-wants-tiktok-data-to-stay-in-europe\/\" rel=\"noreferrer noopener\" target=\"_blank\">told POLITICO<\/a>: \u201cIm not in the business of banning any company. Im in the business of explaining very clearly what our rules are.\u201d<\/p>\n<blockquote><p> While EU regulators have launched investigations into the app, uncertainty hangs over the probes until the question of where TikTok is legally established can be put to rest.<\/p>\n<\/blockquote>\n<p>But it remains unclear what those rules are, or who should enforce them.<\/p>\n<p>While EU regulators have launched investigations into the app, uncertainty hangs over the probes until the question of where TikTok is legally established can be put to rest.<\/p>\n<p>In July, the company <a href=\"https:\/\/www.politico.eu\/?p=1401928\" rel=\"noreferrer noopener\" target=\"_blank\">shifted key data protection functions to Dublin<\/a> in a move toward becoming legally established in Ireland. It would give Irelands Data Protection Commission (DPC) direct oversight over the company for GDPR purposes under the blocs so-called one-stop-shop mechanism for privacy investigations.<\/p>\n<p>But that has not stopped other regulators from launching probes. Frances CNIL data protection agency <a href=\"https:\/\/www.politico.eu\/?p=1432039\" rel=\"noreferrer noopener\" target=\"_blank\">has launched an investigation into TikTok<\/a>, as have its peers in <a href=\"https:\/\/www.politico.eu\/?p=1360595\" rel=\"noreferrer noopener\" target=\"_blank\">the Netherlands,<\/a> <a href=\"https:\/\/www.politico.eu\/?p=1403609\" rel=\"noreferrer noopener\" target=\"_blank\">Denmark<\/a> and <a href=\"https:\/\/www.theguardian.com\/technology\/2019\/jul\/02\/tiktok-under-investigation-over-child-data-use\" rel=\"noreferrer noopener\" target=\"_blank\">the United Kingdom<\/a>. A task force within the Continents privacy regulator grouping, the European Data Protection Board (EDPB) \u2014 <a href=\"https:\/\/www.politico.eu\/?p=1385742\" rel=\"noreferrer noopener\" target=\"_blank\">set up at the behest of the Italian regulator<\/a> \u2014 is also looking into the app.<!--more--><\/p>\n<p>Yet so far, the question of who is in charge remains open. The uncertainty risks undermining a system that has yet to finalize a cross-border investigation against a major tech company in the two years since the GDPR came into force.<\/p>\n<p>\u201cWe strongly believe that there is a need for clarification and guidance when it comes to cross-border inquiries,\u201d said Ernani Cerasaro, a data protection lawyer for consumer rights group BEUC. \u201cMore specifically, there is a need for administrative and investigative procedures (including the handover of the investigations) to be aligned.\u201d<\/p>\n<h3>Whos in charge?<\/h3>\n<p>The central involvement of the Irish regulator underscores the extent to which Dublin has become a pressure point in Europes privacy system.<\/p>\n<p>The DPC, which oversees Silicon Valley giants like Google and Facebook, is under mounting scrutiny by <a href=\"https:\/\/www.politico.eu\/article\/irish-regulator-mismanaged-facebook-privacy-probe-austrian-campaigner-max-schrems\/\" rel=\"noreferrer noopener\" target=\"_blank\">campaigners<\/a> and <a href=\"https:\/\/www.politico.eu\/?p=1430736\" rel=\"noreferrer noopener\" target=\"_blank\">consumer groups<\/a> who say it is handling complaints at a glacial pace.
