Gretchen Whitmers stay-at-home order, ruling that the constitutional rights of the plaintiffs were not infringed but only subjected to \u201ctemporary harm\u201d by measures meant to protect the public amid the pandemic.<\/p>\n<p>Five businesses filed a lawsuit (<a href=\"https:\/\/www.scribd.com\/document\/458892197\/2020-04-28-Filed-Complaint-for-Declatory-Relief-and-Injunctive-Relief#download&amp;from_embed\" rel=\"noreferrer noopener\" target=\"_blank\">pdf<\/a>) against Whitmer and Michigan Department of Health and Human Services Director Robert Gordon, accusing them of violating constitutional rights by lockdown measures imposed to curb the spread of COVID-19, the disease caused by the <a href=\"https:\/\/www.theepochtimes.com\/giving-the-right-name-to-the-virus-causing-a-worldwide-pandemic-2_3277200.html\" rel=\"noreferrer noopener\" target=\"_blank\">CCP (Chinese Communist Party) virus<\/a>.<\/p>\n<p>The Michigan Court of Claims rejected the allegations, ruling that an injunction against Whitmers order \u201cwould not serve the public interest, despite the temporary harm to plaintiffs constitutional rights.\u201d<\/p>\n<p>Court of Claims judge Christopher M. Murray, who was appointed by former Gov. John Engler, stated in an 18-page opinion that constitutional rights are fundamental but not absolute, and under extraordinary circumstances, they may be restricted.<\/p>\n<p>\u201cBut those liberty interests are, and always have been, subject to societys interests\u2014society being our fellow residents. They\u2014our fellow residents\u2014have an interest to remain unharmed by a highly communicable and deadly virus, and since the state entered the Union in 1837, it has had the broad power to act for the public health of the entire state when faced with a public crisis,\u201d the judge wrote.<\/p>\n<p>\u201cAlthough the Court is painfully aware of the difficulties of living under the restrictions of these executive orders, those difficulties are temporary, while to those who contract the virus and cannot recover (and to their family members and friends), it is all too permanent,\u201d he wrote.<\/p>\n<p>\u201cI am pleased with the courts decision,\u201d Attorney General Dana Nessel <a href=\"https:\/\/www.michigan.gov\/ag\/0,4534,7-359-92297_92299-527556--,00.html\" rel=\"noreferrer noopener\" target=\"_blank\">said in a statement<\/a>. \u201cThis pandemic has already taken more than 3,600 lives in Michigan and many more around the world. The primary goal of the Stay Home, Stay Safe order has always been to protect human life.\u201d<\/p>\n<p>The lawsuit alleged that Whitmers \u201cStay Home, Stay Safe\u201d order, recently extended through May 15 though in an amended form that loosened some restrictions, was based on unproven assumptions about how deadly the CCP virus really is.<\/p>\n<figure><img decoding=\"async\" src=\"https:\/\/www.theepochtimes.com\/assets\/themes\/eet\/images\/white.png\" alt=\"Epoch Times Photo\" \/><figcaption><img decoding=\"async\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2020\/04\/16\/protesters-600x400.jpg\" alt=\"Epoch Times Photo\" \/> Protesters attend a rally outside the State Capitol in Lansing, Michigan, on April 15, 2020. (Paul Sancya\/AP Photo)<\/figcaption><\/figure>\n<p>Also, they argued that by suspending the Freedom of Information Act through June 4, Whitmer stymied efforts at assessing whether the models that predict COVID-19 case and death counts in the state of Michigan are sound.<\/p>\n<p>The plaintiffs also alleged that the Emergency Management Act was an unconstitutional delegation of legislative power to the governor. This the judge rejected, claiming the act does not confer \u201cuncontrolled, arbitrary power\u201d to the governor but that it provides highly specific criteria for declaring a disaster or emergency.<\/p>\n<p>The plaintiffs\u2014which included a residential brokerage, an executive property maintenance company, and an exporter of architectural and automotive glass\u2014were seeking \u201ca declaratory and injunctive relief,\u201d meaning a judicial statement and corresponding action blocking the stay-at-home order.<\/p>\n<p>\u201cSuch a declaration, and a corresponding injunction, will yield a more rational, pragmatic response to the virus that saves lives, saves livelihoods, and preserves constitutional norms all at the same time,\u201d the complaint stated.<\/p>\n<figure><img decoding=\"async\" src=\"https:\/\/www.theepochtimes.com\/assets\/themes\/eet\/images\/white.png\" alt=\"Epoch Times Photo\" \/><figcaption><img decoding=\"async\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2020\/04\/21\/GettyImages-1210050174-crop-600x358.jpg\" alt=\"Epoch Times Photo\" \/> People in their vehicles protest against excessive quarantine orders from Michigan Gov.
