{"id":142036,"date":"2020-02-22T06:50:07","date_gmt":"2020-02-22T06:50:07","guid":{"rendered":"https:\/\/www.bnreport.com\/german-hate-speech-crackdown-sparks-censorship-fears\/"},"modified":"2020-02-22T06:50:07","modified_gmt":"2020-02-22T06:50:07","slug":"german-hate-speech-crackdown-sparks-censorship-fears","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/german-hate-speech-crackdown-sparks-censorship-fears\/","title":{"rendered":"German hate speech crackdown sparks censorship fears"},"content":{"rendered":"<p>BERLIN \u2014 Germany is cracking down on hate speech online amid a rise in right-wing extremism, but critics warn that civil liberties will end up as collateral damage.<\/p>\n<p>Hours before a far-right extremist <a href=\"https:\/\/www.politico.eu\/article\/extreme-right-killings-leave-merkel-coalition-searching-for-answers\/\" rel=\"noreferrer noopener\" target=\"_blank\">shot nine people dead<\/a> at two hookah bars in central Germany on Wednesday, Chancellor Angela Merkels government <a href=\"https:\/\/www.politico.eu\/pro\/berlin-moves-ahead-with-tougher-hate-speech-legislation\/?utm_source=POLITICO.EU&amp;utm_campaign=7d36354db1-EMAIL_CAMPAIGN_2020_02_19_10_30&amp;utm_medium=email&amp;utm_term=0_10959edeb5-7d36354db1-189775021\" rel=\"noreferrer noopener\" target=\"_blank\">passed the first of two laws<\/a> to further toughen its rules \u2014 already considered some of the worlds strictest \u2014 governing speech online.<\/p>\n<p>\u201cHate crimes should finally end up where they belong \u2014 in court,\u201d said the Social Democrat Justice Minister Christine Lambrecht after the bill was approved by the government.<\/p>\n<p>The draft law will force social media companies to proactively report potentially criminal content on their platforms to law enforcement.<\/p>\n<p>While Lambrechts government argues the measures are needed to counter <a href=\"https:\/\/www.dw.com\/en\/germany-number-of-right-wing-extremists-rose-by-a-third-in-2019\/a-51698446\" rel=\"noreferrer noopener\" target=\"_blank\">a rise in right-wing extremism <\/a>proliferating online, however, an unlikely alliance of opponents are sounding the alarm on potential damages to civil liberties.<\/p>\n<blockquote><p> Berlins hate speech law provides a major test case of cracking down on hate speech online.<\/p>\n<\/blockquote>\n<p>\u201cThere is no question that our society has a problem with right-wing extremism and hate speech,\u201d said Elisabeth Niekrenz of Berlin-based civil liberties organization Digitale Gesellschaft (Digital Society), \u201cwhich deeply worries me. But the measures presented [by Lambrecht] infringe peoples right to informational self-determination, open the door for more surveillance, grant law enforcement more powers to intervene and allow for more data collection.\u201d<\/p>\n<p>Niekrenzs organization is one of 13 signatories of <a href=\"https:\/\/digitalegesellschaft.de\/wp-content\/uploads\/2020\/02\/20200211_offener_brief_netzdg-e_und_bekampfung_hasskriminalitat.pdf\" rel=\"noreferrer noopener\" target=\"_blank\">an open letter<\/a> to Lambrecht earlier this month which called the new hate speech rules \u201can enormous danger to civil liberties.\u201d Other signatories include Germanys journalists union, the German Informatics Society, as well as lobbying organizations for the tech industry such as the Association of the Internet Industry (eco), which counts Facebook, Google and Twitter among its <a href=\"https:\/\/www.eco.de\/ueber-eco\/mitglieder\/\" rel=\"noreferrer noopener\" target=\"_blank\">members<\/a>.<\/p>\n<p>Niekrenz added that while her organizations interests were opposed to those of Big Tech \u201cin many areas\u201d, for example on the handling of user data, \u201cits fair to say that here, the big platforms are pushed into a peculiar role in which theyre supposed to play deputy sheriffs and have to decide whats lawful and what isnt.\u201d<\/p>\n<p>\u201cThis doesnt bother me because I feel sorry for Facebook or Google having to do the work, but because I am concerned about the societal consequences,\u201d she added.<!--more--><\/p>\n<p>The German justice ministry denied a request to reply to their criticism, citing a policy of not commenting on open letters.<\/p>\n<p> <img decoding=\"async\" src=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2020\/02\/GettyImages-1202239733-714x476.jpg\"\/><\/p>\n<p>The uproar in Germany underscores how challenging the regulation of online content is for democratic countries | Odd Andersen\/AFP via Getty Images<\/p>\n<p>Berlins hate speech law also provides a major test case of cracking down on hate speech online at a time when the European Commission is examining new rules for policing content online \u2014 and looking closely at how  Germany, France and the United Kingdom are handling the matter.<\/p>\n<p>The uproar in Germany underscores how challenging the regulation of online content is for democratic countries. Critics warn in particular that well-meaning efforts in Europe could provide a template for censorship of political opponents in autocratic countries.<\/p>\n<p>Lambrecht hinted, however, that Berlins rulebook could serve as a role model for other EU countries. Following a meeting earlier this month with colleagues from the Netherlands, Luxembourg, France, Spain and Italy, <a href=\"https:\/\/www.politico.eu\/pro\/germany-to-focus-on-hate-speech-during-eu-presidency-says-minister\/?utm_source=POLITICO.EU&amp;utm_campaign=4fc760535b-EMAIL_CAMPAIGN_2020_02_12_03_59&amp;utm_medium=email&amp;utm_term=0_10959edeb5-4fc760535b-189775021\" rel=\"noreferrer noopener\" target=\"_blank\">she said<\/a> that Germany will push for cooperation and \u201cnew European rules\u201d to fight online hate speech during its rotating presidency of the EU starting this summer.<\/p>\n<p>\u201cIn many European countries, populists and extremists are rioting against democracy, dissenters and minorities,\u201d she said. \u201cThe platforms are the same, and the racist and anti-Semitic messages are similar.\u201d<\/p>\n<h3>What defines hate?<\/h3>\n<p>Germanys efforts to snuff out online hate speech passed a milestone in the summer of 2017, when parliament passed its Network Enforcement Act (NetzDG).<\/p>\n<p>The law forces large social media platforms to delete potential criminal content, sometimes within as little as 24 hours.
