An appeals court panel said President Donald Trump can use $3.6 billion in military funds for the southern border wall.<\/p>\n

The Jan. 8 ruling came less than a month after U.S. District Judge David Briones, who was appointed by President Bill Clinton, issued a permanent nationwide injunction<\/a> against using the funds.<\/p>\n

The Fifth Circuit Court of Appeals granted a stay of the Texas judges injunction as the case continues.<\/p>\n

Judge Edith Jones, an appointee of President Ronald Reagan, and Trump appointee Judge Andrew Oldham ruled to block the lower courts ruling, while Judge Stephen Higginson, a President Barack Obama appointee, dissented.<\/p>\n

The judges who granted the Trump administrations request noted that the Supreme Court recently blocked a similar injunction. The panel also said there was a \u201csubstantial likelihood\u201d that the parties challenging the transfer, the county of El Paso, Texas, and the Border Network for Human Rights, didnt have standing to sue the Trump administration.<\/p>\n

\u201cThe Supreme Court recently stayed a similar injunction from our sister circuit,\u201d the judges wrote (pdf<\/a>). \u201cThe Government is entitled to the same relief here for, among other reasons, the substantial likelihood that Appellees lack Article III standing.\u201d<\/p>\n

Higginson, meanwhile, wrote in his dissent: \u201cI am unable to agree, without focused panel deliberation and discussion\u2014possibly aided by dialogue with counsel\u2014that the government presently has shown either a likelihood of success on the merits or irreparable harm in the absence of a stay.\u201d He called to expedite merits assessment by the court, noting the rulings surrounding the border wall involve \u201cweighty issues.\u201d<\/p>\n

Trump hailed the decision.<\/p>\n
