{"id":139276,"date":"2019-11-30T10:00:35","date_gmt":"2019-11-30T10:00:35","guid":{"rendered":"https:\/\/www.bnreport.com\/judge-issues-temporary-stay-of-her-own-order-for-don-mcgahn-to-comply-with-subpoena\/"},"modified":"2019-11-30T10:00:35","modified_gmt":"2019-11-30T10:00:35","slug":"judge-issues-temporary-stay-of-her-own-order-for-don-mcgahn-to-comply-with-subpoena","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/judge-issues-temporary-stay-of-her-own-order-for-don-mcgahn-to-comply-with-subpoena\/","title":{"rendered":"Judge Issues Temporary Stay of Her Own Order for Don McGahn to Comply With Subpoena"},"content":{"rendered":"<p>A federal judge issued a stay of her own order on Nov. 27, two days after she said former White House counsel Don McGahn had to comply with a subpoena from House Democrats.<\/p>\n<p>McGahn asked President Barack Obama-appointee Judge Kentanji Brown Jackson, a district court judge in Washington, for a temporary stay on Wednesday morning.<\/p>\n<p>Jackson granted the temporary stay while she decides whether to grant McGahn a longer stay which would block him from having to appear as he appeals her decision.<\/p>\n<p>The House Judiciary Committee, which asked the court to enforce the subpoena, said it didnt oppose the temporary stay.<\/p>\n<p>McGahn is being represented by the Department of Justice, <a href=\"https:\/\/www.theepochtimes.com\/justice-department-to-appeal-after-federal-judge-rules-mcgahn-must-testify-to-house_3157027.html\" rel=\"noreferrer noopener\" target=\"_blank\">which said<\/a> it was appealing Jacksons decision.<\/p>\n<p>Jackson in her ruling rejected the White Houses \u201cabsolute immunity\u201d argument to prevent McGahn from appearing to testifying, saying that McGahn is required to appear before the House Judiciary Committee for testimony but is allowed to assert privilege on questions asked during a hearing, where appropriate.<\/p>\n<p>\u201cThis Court holds that individuals who have been subpoenaed for testimony by an authorized committee of Congress must appear for testimony in response to that subpoena\u2014i.e., they cannot ignore or defy congressional compulsory process, by order of the President or otherwise,\u201d Jackson wrote in her opinion.<\/p>\n<p>The White House confirmed that the administration will also appeal the ruling, adding that they were \u201cconfident that the important constitutional principle advanced by the administration will be vindicated.\u201d<\/p>\n<p>\u201cThis decision contradicts longstanding legal precedent established by administrations of both political parties,\u201d White House press secretary Stephanie Grisham said in a statement.<\/p>\n<p>McGahn, who was viewed as a key witness in former special counsels Robert Muellers investigation, was subpoenaed by the House Judiciary Committee in April to provide documents and appear before lawmakers as part of their investigation of possible obstruction of justice by Trump\u2014something that Mueller did not conclude in his report. Trump has denied any wrongdoing.<\/p>\n<p>The White House blocked his appearance in May, asserting privilege over the documents.
