{"id":136845,"date":"2019-11-05T10:30:34","date_gmt":"2019-11-05T10:30:34","guid":{"rendered":"https:\/\/www.bnreport.com\/mulvaney-aide-among-those-declining-to-testify-in-impeachment-inquiry\/"},"modified":"2019-11-05T10:30:34","modified_gmt":"2019-11-05T10:30:34","slug":"mulvaney-aide-among-those-declining-to-testify-in-impeachment-inquiry","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/mulvaney-aide-among-those-declining-to-testify-in-impeachment-inquiry\/","title":{"rendered":"Mulvaney Aide Among Those Declining to Testify in Impeachment Inquiry"},"content":{"rendered":"<p>Four White House officials, including the top aide to White House Chief of Staff Mick Mulvaney, wont testify in the impeachment inquiry on Monday.<\/p>\n<p>The White House had directed officials not to comply with the inquiry because of executive privilege.<\/p>\n<p>Robert Blair, assistant to President Donald Trump and senior adviser to Mulvaney, wont appear \u201cpursuant to direction from the White House, which is based on advice from the Department of Justice,\u201d his attorney, Whit Ellerman, <a href=\"https:\/\/www.politico.com\/news\/2019\/11\/02\/robert-blair-wont-testify-monday-064447\" rel=\"noreferrer noopener\" target=\"_blank\">told Politico<\/a>.<\/p>\n<p>Blair wouldnt appear even if he was subpoenaed, Ellerman said. The \u201cdirection from the White House and advice from DOJ cover subpoena.\u201d<\/p>\n<p>Three other White House aides were summoned to testify on Monday but werent going to participate.<\/p>\n<p>Brian McCormack, associate director for natural resources energy and science at the Office of Management and Budget, declined to appear to answer questions in a closed-door hearing.<\/p>\n<p>The other two aides slated to testify\u2014John Eisenberg, deputy counsel to the president for National Security Affairs, and Michael Ellis, senior associate counsel to the president\u2014also werent going to appear.<\/p>\n<p>White House counsel Pat Cipollone wrote in a letter to William Burck, Eisenbergs attorney, over the weekend that the Department of Justice advised him that Eisenberg was \u201cabsolutely immune from compelled congressional testimony with respect to matters related to his service as a senior adviser to the President.\u201d In another letter, Burck notified House Democrats on Monday that his client wouldnt be appearing, noting the subpoena issued to try to force Eisenberg to appear didnt come until Friday.<\/p>\n<p>\u201cEven if Mr. Eisenberg had been afforded a reasonable amount of time to prepare, the President has instructed Mr. Eisenberg not to appear at the deposition,\u201d Burck wrote.<\/p>\n<figure><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2019\/10\/31\/adam-schiff-on-impeachment-1200x800.jpg\" rel=\"noreferrer noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.theepochtimes.com\/assets\/themes\/eet\/images\/white.png\" alt=\"adam schiff\" \/><figcaption><img decoding=\"async\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2019\/10\/31\/adam-schiff-on-impeachment-1200x800.jpg\" alt=\"adam schiff\" \/><\/figcaption><\/a> House Intelligence Committee Chairman Rep. (Chip Somodevilla\/Getty Images)<\/figure>\n<p>Two other officials, Michael Duffey and Russel Vought, both of the Office of Management and Budget, were also not going to appear for depositions scheduled by House Democrats later this week, a source told CNN.<\/p>\n<p>A former aide, Charles Kupperman, has asked a federal judge to rule whether he should obey Trumps direction or comply with House Democrat efforts.<\/p>\n<p>The judge set a trial date for Dec. 10 and pushed back when a Department of Justice lawyer asked for more time to file briefs because of the Thanksgiving holiday.<\/p>\n<p>\u201cWhen its a matter of this consequence to this country you roll your sleeves up and get the job done,\u201d Senior U.S. District Judge Richard Leon, a President George W. Bush appointee, told her <a href=\"https:\/\/www.theepochtimes.com\/judge-sets-date-for-arguments-in-case-of-ex-trump-aide-who-ignored-impeachment-testimony-request_3134485.html\" rel=\"noreferrer noopener\" target=\"_blank\">on Oct. 31<\/a>.<\/p>\n<p>Other officials have testified in the inquiry.<\/p>\n<p>Alexander Vindman, the National Security Council director for European affairs, <a href=\"https:\/\/www.theepochtimes.com\/white-house-official-who-listened-to-trumps-ukraine-call-testifies-in-impeachment-inquiry_3131030.html\" rel=\"noreferrer noopener\" target=\"_blank\">told lawmakers<\/a> that he was concerned about Trumps phone call with Ukrainian President Volodymyr Zelensky.<\/p>\n<p>\u201cI was concerned by the call.
