{"id":136544,"date":"2019-11-02T17:30:21","date_gmt":"2019-11-02T17:30:21","guid":{"rendered":"https:\/\/www.bnreport.com\/judge-sets-date-for-arguments-in-case-of-ex-trump-aide-who-ignored-impeachment-testimony-request\/"},"modified":"2019-11-02T17:30:21","modified_gmt":"2019-11-02T17:30:21","slug":"judge-sets-date-for-arguments-in-case-of-ex-trump-aide-who-ignored-impeachment-testimony-request","status":"publish","type":"post","link":"https:\/\/www.bnreport.com\/en\/judge-sets-date-for-arguments-in-case-of-ex-trump-aide-who-ignored-impeachment-testimony-request\/","title":{"rendered":"Judge Sets Date for Arguments in Case of Ex-Trump Aide Who Ignored Impeachment Testimony Request"},"content":{"rendered":"<p>A federal judge set a date for oral arguments in the case of the former aide to President Donald Trump who has asked the judge to rule whether he should testify in the impeachment probe or obey the White House and not testify.<\/p>\n<p>Charles Kupperman <a href=\"https:\/\/www.theepochtimes.com\/former-trump-aide-asks-judge-to-rule-on-whether-he-has-to-testify-in-impeachment-inquiry_3128339.html\" rel=\"noreferrer noopener\" target=\"_blank\">on Oct. 25<\/a> asked a judge to weigh in on whether he should listen to Trumps White House, which is arguing Kupperman shouldnt testify due to executive privilege, or House Democrats, who issued a subpoena.<\/p>\n<p>\u201cPlaintiff is faced with irreconcilable commands by the Legislative and Executive Branches of the Government and, accordingly, seeks a declaratory judgment from this Court as to whether he is lawfully obliged to comply with a subpoena issued by the House Defendants demanding his testimony pursuant to the House of Representatives impeachment inquiry, or he is lawfully obliged to abide by the assertion of immunity from congressional process made by the President in connection with the testimony sought from Plaintiff,\u201d the lawsuit states.<\/p>\n<p>Kupperman, who was deputy national security adviser at the White House until September, declined to appear on Capitol Hill for a scheduled appearance despite threats from Democrats that they might open a contempt proceeding against him.<\/p>\n<p>\u201cWe want to assure your clients, again, that it is not Dr. Kupperman who contests your clients constitutional claim,\u201d Kuppermans attorney, Charles Cooper, wrote to the legal counsel for the House Intelligence Committee.<\/p>\n<figure><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2019\/10\/31\/adam-schiff-on-impeachment-1200x800.jpg\" rel=\"noreferrer noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.theepochtimes.com\/assets\/themes\/eet\/images\/white.png\" alt=\"adam schiff\"\/><figcaption><img decoding=\"async\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2019\/10\/31\/adam-schiff-on-impeachment-1200x800.jpg\" alt=\"adam schiff\"\/><\/figcaption><\/a> House Intelligence Committee Chairman Rep.
