Rick Perry, who is resigning from his position as Energy Secretary at the end of the year, will not supply documents that House Democrats have subpoenaed as part of their impeachment inquiry into President Donald Trump.<\/p>\n

In a letter to Democratic lawmakers, Assistant Secretary of Energy Melissa F. Burnison pointed out that the House has not formally voted on a resolution to open an impeachment inquiry, and therefore the House had failed to \u201cvalidly authorize the impeachment inquiry.\u201d<\/p>\n

She wrote that \u201ca Congressional committee cannot exercise the investigative power of the full House of Representatives unless it has that power through proper delegation.\u201d<\/p>\n

Burnison also echoed a similar point made by an earlier letter<\/a> from White House counsel Pat Cipollone on Oct. 8, which pointed out that the House had never in U.S. history tried to launch an impeachment inquiry against a president without a majority House vote.<\/p>\n

\u201cEven if the inquiry was validly authorized, much of the information sought in the subpoena appears to consist of confidential Executive Branch communications that are potentially protected by executive privilege and would require careful review to ensure that no such information is improperly disclosed,\u201d Burnison wrote.<\/p>\n

The Energy Department also said in the letter it does not accept the House committees position that failure to comply with the subpoena would equate to obstruction.<\/p>\n

\u201cThe Department remains committed to working with Congress on matters of mutual importance conducted in accordance with proper authorizations and procedures,\u201d she added.<\/p>\n

The subpoena related to Perry came on Oct. 10. House Intelligence Chairman Rep. Adam Schiff (D-Calif.), House Foreign Affairs Chairman Representative Eliot Engel (D-N.Y.), and House Oversight and Reform Chairman Elijah Cummings (D-Md.) wrote to Perry in a statement<\/a>:<\/p>\n

\u201cRecently, public reports have raised questions about any role you may have played in conveying or reinforcing the presidents stark message to the Ukrainian president.<\/p>\n

\u201cThese reports have also raised significant questions about your efforts to press Ukrainian officials to change the management structure at a Ukrainian state-owned energy company to benefit individuals involved with Rudy Giulianis push to get Ukrainian officials to interfere in our 2020 election.\u201d<\/p>\n

Perry, who submitted his resignation to Trump on Thursday, told Fox News in an interview on Friday morning that he had urged Trump to call Zelensky to talk about fighting corruption and how U.S. liquefied natural gas could help ease dependency on gas from Russia.<\/p>\n

\u201cThere was no quid pro quo in the sense of what those folks out there would like for it to be: That were [not] going to give you this money unless you investigate Joe Biden and his son,'\u201d Perry said on Fox News. \u201cI never heard that said, anywhere, anytime, in any conversation.\u201d<\/p>\n

Perry said he aimed to \u201cget Ukraine back in the sphere of influence in the United States.\u201d<\/p>\n
