But for once, its not about Brexit.<\/p>\n<p>The U.K. government is soon expected to publish its flagship internet regulation aimed at taming the perceived excesses of Big Tech, including forcing social media companies to take greater responsibility \u2014 and face potentially hefty fines \u2014 for harmful content published on their networks.<\/p>\n<p>But in their effort to clamp down on Facebook, Google and others, British politicians are running into a wall of resistance from the tech industry and civil rights organizations.<\/p>\n<p>These groups fear that peoples freedom of expression and ability to access information online could be harmed if Westminster places too much onus on tech companies to regulate the web, and some are already warning the proposals will face legal challenges.<\/p>\n<p>\u201cIts clear that something has to be done to combat harmful content,\u201d said Martin Moore, director of the Centre for the Study of Media, Communication and Power at Kings College London. \u201cBut well quickly descend into arguments about what that harm is. The devil is in the detail.\u201d<\/p>\n<blockquote>\n<p>\u201cThe success or failure of the governments proposals on online harms will depend on getting the details right\u201d <em>\u2014 Vinous Ali, head of policy at techUK<\/em><\/p>\n<\/blockquote>\n<p>Britain has become the latest battleground in a worldwide push to regulate digital content, following <a href=\"https:\/\/www.politico.eu\/article\/germany-hate-speech-netzdg-facebook-youtube-google-twitter-free-speech\/\" rel=\"noreferrer noopener\" target=\"_blank\">efforts in Paris, Berlin, Brussels<\/a> and elsewhere to <a href=\"https:\/\/ec.europa.eu\/commission\/news\/code-practice-against-disinformation-2019-jan-29_en\" rel=\"noreferrer noopener\" target=\"_blank\">force social media companies<\/a> to be more responsible for what appears on their sites.<\/p>\n<p>In particular, the U.K. government is expected to impose a so-called duty of care on internet platforms operating within the country, which will place a statutory obligation on them to police, monitor and remove content that is perceived to cause harm online. If they dont act, they may face regulatory fines.<\/p>\n<p>That material includes terrorist propaganda, potential misinformation and online bullying, particularly aimed at young people, and follows <a href=\"https:\/\/www.bbc.co.uk\/news\/av\/uk-46966009\/instagram-helped-kill-my-daughter\" rel=\"noreferrer noopener\" target=\"_blank\">widespread public anger<\/a> over the death of Molly Russell, a 14-year-old whose Instagram account was filled with images of depression and suicide.<\/p>\n<p>The Facebook-owned photo-sharing platform subsequently <a href=\"https:\/\/www.theguardian.com\/technology\/2019\/feb\/07\/instagram-bans-graphic-self-harm-images-after-molly-russells-death\" rel=\"noreferrer noopener\" target=\"_blank\">pledged to remove<\/a> all self-harming images from its site after U.K. lawmakers, including Matt Hancock, the countrys health secretary, called on social media firms to better police online material.<\/p>\n<p> <img decoding=\"async\" src=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2019\/03\/GettyImages-1133223268-714x476.jpg\"\/><\/p>\n<p>Theresa May fears that the current chaos in Westminster will overshadow the online harms announcement | Jack Taylor\/Getty Images<\/p>\n<p>Now, industry insiders say they are gearing up for more of the same in the upcoming British white paper, which is ready to be published, but has been repeatedly postponed because of <a href=\"https:\/\/www.politico.eu\/section\/brexit\/.\" rel=\"noreferrer noopener\" target=\"_blank\">Brexit<\/a>.<\/p>\n<p>Theresa May, <a href=\"https:\/\/www.politico.eu\/person\/theresa-may\/\" rel=\"noreferrer noopener\" target=\"_blank\">the embattled British prime minister<\/a>, fears that the current chaos in Westminster will overshadow the online harms announcement, which comes after months of government promises to take action against internet companies.<\/p>\n<p>This delay has allowed industry lobbyists to push their case to water down the proposals, claiming that London has yet to define what constitutes online harm, and that elected officials \u2014 not private companies \u2014 should decide what is allowed online.<\/p>\n<p>\u201cThe success or failure of the governments proposals on online harms will depend on getting the details right,\u201d said Vinous Ali, head of policy at techUK, a trade group. \u201cThe concern is that we have yet to move past broad slogans.\u201d<\/p>\n<h3><strong>Political pressure<\/strong><\/h3>\n<p>Despite these efforts, industry groups and social media companies are preparing themselves for more regulation, in part because of widespread public anger among British voters \u2014 often fueled by the local media \u2014 over the failure of tech companies to clamp down on illegal and harmful content.<\/p>\n<p>Even given Mays current political Brexit difficulties, her focus to push through greater scrutiny over Big Tech \u2014 via the upcoming white paper, some of which would still need to be turned into legislation, which would likely take years \u2014 has widespread political support.<\/p>\n<p>Plans for the online harm reforms, for instance, are rooted in the ruling <a href=\"https:\/\/s3.eu-west-2.amazonaws.com\/conservative-party-manifestos\/Forward+Together+-+Our+Plan+for+a+Stronger+Britain+and+a+More+Prosperous....pdf\" rel=\"noreferrer noopener\" target=\"_blank\">Conservative Partys 2017 general election manifesto<\/a>, which promised to \u201ctake steps to protect the vulnerable and give people confidence to use the internet without fear of abuse, criminality or exposure to horrific content.\u201d<\/p>\n<blockquote>\n<p>If Big Tech fails to act, U.K. officials are likely to recommend the creation of a new regulator with potential significant fining powers to enforce compliance.<\/p>\n<\/blockquote>\n<p>Matt Hancock, the U.K.s then-digital secretary before leaving to take over the health portfolio, promised to bring in internet safety laws in May 2018, with a focus on creating a duty of care principle, according to figures close to the discussions. That concept has garnered support from both Jeremy Wright, the current digital secretary, and Sajid Javid, the U.K.s home secretary.<\/p>\n<p>\u201cTech companies who dont clean up their platforms should be prepared to face the force of the law,\u201d Javid <a href=\"https:\/\/www.express.co.uk\/news\/politics\/1100815\/new-zealand-attack-christchurch-mosque-attack-sajid-javid\" rel=\"noreferrer noopener\" target=\"_blank\">wrote in the Express<\/a> in the aftermath of the recent New Zealand terrorist attack, which was live-streamed on Facebook.<\/p>\n<h3><strong>Duty of care<\/strong><\/h3>\n<p>Central to the U.K. governments plans is the \u201cduty of care.\u201d<\/p>\n<p>Focusing on the need to keep people safe online, any future British law is expected to define categories of harmful content, like cyberbullying or online grooming, and then require social media firms to monitor and remove such material before it causes damage, <a href=\"https:\/\/www.telegraph.co.uk\/politics\/2019\/03\/08\/exclusive-social-media-firms-placed-statutory-duty-care-protect\/\" rel=\"noreferrer noopener\" target=\"_blank\">according to a leak to the Telegraph.<\/a><\/p>\n<p>If Big Tech fails to act, U.K. officials are likely to recommend the creation of a new regulator with potential significant fining powers to enforce compliance.<\/p>\n<p>On a daily basis, such monitoring will remain within the private companies, which will have to rely on technical solutions, like artificial intelligence, and human content moderators to ensure all harmful material is removed.
