Ministers will be joined by Commission Vice President Andrus Ansip in Brussels for <a href=\"http:\/\/www.philippedebacker.com\/ai-4-belgium-coalition-stelt-strategie-voor-op-vraag-van-alexander-de-croo-en-philippe-de-backer\/\" rel=\"noreferrer\" target=\"_blank\">the presentation<\/a>, which \u2014 like Europes grand plan for AI \u2014 asserts that AI will create jobs in high-end industries and manufacturing, with ethics as a guiding idea.<\/p>\n<p>A survey out this morning, seen by POLITICO, shows that Belgians are enthusiastic about the benefits of AI. But it also raises red flags about public support, with 85 percent of respondents saying they were concerned about the privacy implications of AI technology. Belgium still has some convincing to do, just as the rest of Europe does.<\/p>\n<p>Meanwhile the EUs high-level expert group <a href=\"http:\/\/ec.europa.eu\/transparency\/regexpert\/index.cfm?do=groupDetail.groupMeetingDoc&amp;docid=28865\" rel=\"noreferrer\" target=\"_blank\">meets<\/a> today and tomorrow to finalize non-binding guidelines for \u201ctrustworthy\u201d AI to be released in early April. Members will also start to discuss their next report, which focuses on boosting European investment into AI and is due for publication early this summer.<!--more--><\/p>\n<p>Though its non-binding, that second document will set the tone for what sort of regulation, if any, is needed. The group remains deeply divided. Some members argue that Europe should control its urge to regulate and let courts issue rulings as the technology progresses. Views on Europes attitude range from \u201cits an act of genius\u201d to \u201cslow suicide.\u201d Click <a href=\"https:\/\/www.politico.eu\/pro\/europe-silver-bullet-global-ai-battle-ethics\/\" rel=\"noreferrer\" target=\"_blank\">here<\/a> or scroll down for Janosch Delckers dive into how the world views Europes principle-based approach to innovation.<\/p>\n<table>\n<tbody>\n<tr>\n<td>ILLEGAL CONTENT<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>TERROR ATTACK PUTS SPOTLIGHT ON PLATFORM MODERATION:<\/strong> Footage of the terrorist attack in New Zealand remained accessible on various social media platforms hours after it was uploaded as hosts <a href=\"https:\/\/mashable.com\/article\/shooting-live-stream-christchurch\/?europe=true#JgBc7p694aqc\" rel=\"noreferrer\" target=\"_blank\">struggled<\/a> to contain its viral spread. The effort started with a live stream and veered to removing a huge number of <a href=\"https:\/\/www.numerama.com\/politique\/471963-attaque-terroriste-en-nouvelle-zelande-le-\" rel=\"noreferrer\" target=\"_blank\">re-uploads by other users<\/a>. Facebook <a href=\"https:\/\/twitter.com\/fbnewsroom\/status\/1107117981358682112\" rel=\"noreferrer\" target=\"_blank\">said<\/a> it had removed 1.5 million videos of the attack in the first 24 hours, including 1.2 million that were blocked upon upload.<\/p>\n<p><strong>U.K.<\/strong> <strong>Home Secretary Sajid Javid:<\/strong> \u201cTech companies must do more to stop his messages being broadcast on their platforms \u2026 This is the type of illegal behavior that our new Online Harms White Paper will address.\u201d<\/p>\n<p><strong>In Brussels,<\/strong> policymakers pointed to the terrorist content legislation that is currently under discussion and makes platforms legally responsible for removing illegal content within a time limit. Daniel Dalton, the regulations rapporteur in the European Parliament, said that \u201cupload filters would have struggled to prevent this sickening content being picked up in time \u2026 However, it is completely unacceptable that this video can still be easily accessed on some platforms several hours after the shooting. This only goes to show why this law is needed.\u201d<\/p>\n<p><strong>DALTON FLOATS NEW COMPROMISE AMENDMENTS:<\/strong> The British MEP <a href=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2019\/03\/SPOLITICO-19031517460.pdf\" rel=\"noreferrer\" target=\"_blank\">made proposals<\/a>, obtained by Morning Tech, on the second half of the terrorist content legislation, which is to be discussed this week with the negotiation team (its unclear whether todays shadow meeting is maintained or postponed to Tuesday). Main changes include new transparency requirements in cases where material was wrongly identified as terrorist content (article 8) and obligations for platforms to inform users about the outcome of their complaints within two weeks (article 10). EU countries would have to designate a single competent authority, which can be of administrative or judicial nature (article 17), and penalties should take into account the size of the company (article 18).<\/p>\n<table>\n<tbody>\n<tr>\n<td>DATA PROTECTION <\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>USERS TRACKED ON PUBLIC WEBSITES:<\/strong> EU citizens are unknowingly tracked online by ad tech companies when they visit government and public sector websites, according to a study to be released today. Nearly 90 percent of EU official government websites and 52 percent of landing pages on national health services contain third-party ad tracking, the study reads. On the French government website, users are tracked by 52 different companies, said the study carried out by Cookiebot, a company helping organizations to become GDPR-compliant and supported by Brussels-based digital rights NGO EDRi.<\/p>\n<p><strong>The e-Privacy angle: <\/strong>EDRi said the study was proof that e-Privacy Regulation needs to be adopted sooner rather than later. The legislation, currently stuck in the Council of the EU, could require companies to obtain users consent before tracking them online.<\/p>\n<p><strong>In other e-Privacy news, <\/strong>the European Data Protection Board released <a href=\"https:\/\/edpb.europa.eu\/sites\/edpb\/files\/files\/file1\/201905_edpb_opinion_eprivacydir_gdpr_interplay_en_0.pdf\" rel=\"noreferrer\" target=\"_blank\">an opinion<\/a> on the interaction between e-Privacy and GDPR.<\/p>\n<table>\n<tbody>\n<tr>\n<td>EU ELECTION<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>RAPID ALERT SYSTEM KICKS OFF TODAY:<\/strong> <a href=\"https:\/\/cdn2-eeas.fpfis.tech.ec.europa.eu\/cdn\/farfuture\/l6W-RvpX1UwJNQvJZNKWEZbQNw4GhhhH6G3VNcZb11U\/mtime:1552647850\/sites\/eeas\/files\/ras_factsheet_march_2019_0.pdf\" rel=\"noreferrer\" target=\"_blank\">The alert system<\/a> is one of the main aspects of the EU action plan against disinformation and aims at ensuring cross-border sharing of information, trends and best practices. A meeting is organized today with contact people in the EU countries, according to an EU official. The <a href=\"https:\/\/ec.europa.eu\/digital-single-market\/en\/news\/european-media-literacy-week\" rel=\"noreferrer\" target=\"_blank\">European media literacy week<\/a> also starts today.<\/p>\n<p><strong>High-level platform meeting:<\/strong> Google, Facebook and Twitter <a href=\"http:\/\/europa.eu\/rapid\/press-release_CLDR-19-1709_en.htm\" rel=\"noreferrer\" target=\"_blank\">will meet<\/a> with no fewer than four commissioners Tuesday to follow up on the implementation of the code of practice on disinformation. Commission VP Andrus Ansip, Justice Commissioner V\u0115ra Jourov\u00e1, Security Commissioner Julian King and Digital Commissioner Mariya Gabriel will be there.<\/p>\n<p><strong>THE EDPBS WARNINGS:<\/strong> The European Data Protection Board adopted <a href=\"https:\/\/edpb.europa.eu\/sites\/edpb\/files\/files\/file1\/edpb-2019-03-13-statement-on-elections_en.pdf\" rel=\"noreferrer\" target=\"_blank\">a statement<\/a> on the use of personal data in the context of the EU election to remind political parties and social media platforms about GDPR principles. Among other warnings, the EDPB said that personal data revealing political opinions can only be processed under strict conditions and that even public personal data are protected by the GDPR.<\/p>\n<table>\n<tbody>\n<tr>\n<td>COMPETITION<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>APPLE STRIKES BACK AT SPOTIFY:<\/strong> \u201cAfter using the App Store for years to dramatically grow their business, Spotify seeks to keep all the benefits of the App Store ecosystem \u2026 without making any contributions to that marketplace,\u201d the iPhone maker wrote in a <a href=\"https:\/\/www.apple.com\/newsroom\/2019\/03\/addressing-spotifys-claims\/\" rel=\"noreferrer\" target=\"_blank\">blog post<\/a>. Spotify <a href=\"https:\/\/www.politico.eu\/article\/spotify-picks-antitrust-fight-with-apple\/\" rel=\"noreferrer\" target=\"_blank\">filed a complaint<\/a> to the European Commission last week arguing Apple unfairly favors its own music services over rivals.<\/p>\n<p><strong>Oh no, they didnt:<\/strong> Apple sought to paint Spotify as a profiteer. \u201cUnderneath the rhetoric, Spotifys aim is to make more money off others work,\u201d the tech giant wrote, referring to <a href=\"https:\/\/www.musicbusinessworldwide.com\/how-spotify-could-pinch-back-over-320m-from-songwriters-with-its-new-legal-appeal\/\" rel=\"noreferrer\" target=\"_blank\">Spotifys legal challenge<\/a> of the U.S. Copyright Royalty Board decision to raise songwriter pay from streaming services by at least 44 percent. The iPhone maker did not directly refer to Spotifys \u201cdual role\u201d argument.<\/p>\n<p><strong>Spotify receives support of the publishing industry:<\/strong> The European Publishers Council encounters the same kinds of issues when dealing with Apple and the App Store, the organization said <a href=\"http:\/\/epceurope.eu\/news-media-development-on-mobile-stifled-by-anti-competitive-app-stores-european-publishers-council-supports-spotifys-eu-competition-case\/\" rel=\"noreferrer\" target=\"_blank\">in a statement<\/a>. \u201cThe dominance of the two main app stores of Apple and Google is also harming news media providers,\u201d the lobby said, adding it \u201cfully supports Spotifys EU competition case which seems set to become a landmark case in an issue that affects all European media players and consumers.\u201d<\/p>\n<p><strong>GOOGLE SHOPPING REMEDIES:<\/strong> Ahead of a likely fine against its <a href=\"https:\/\/www.politico.eu\/pro\/eu-to-impose-third-fine-on-google-next-week\/\" rel=\"noreferrer\" target=\"_blank\">separate AdSense service<\/a>, the search giant is making changes in its \u201cvertical search\u201d remedies. The changes, which are starting to be rolled out across Europe, will allow users to be directed to the websites of comparison shopping sites, and not just to the products shown in Googles ads, according to a person with direct knowledge of the matter. The changes are aimed at resolving complaints that the current remedies do not help them receive additional web traffic when people click on Googles advertising.<\/p>\n<p><strong>BENOIT HAMON WANTS TO BREAK UP GOOGLE AND CO.:<\/strong> Elizabeth Warren has a supporter across the Atlantic. Former French Socialist presidential candidate, whose political movement G\u00e9n\u00e9ration.s will present a list to the EU election, <a href=\"https:\/\/www.numerama.com\/politique\/472045-benoit-hamon-veut-demanteler-les-gafa-quil-juge-trop-puissants.html\" rel=\"noreferrer\" target=\"_blank\">wants<\/a> the break up of big tech companies to be a campaign issue.<\/p>\n<table>\n<tbody>\n<tr>\n<td>COPYRIGHT<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>IN GERMANY, CDU WORKS ON COPYRIGHT REFORM IMPLEMENTATION:<\/strong> The conservative party, which is torn between support and opposition of the copyright reform text, is already thinking about how to transpose the directive into German law. According to a paper <a href=\"http:\/\/www.spiegel.de\/politik\/deutschland\/eu-urheberrechtsreform-cdu-will-die-uploadfilter-beerdigen-a-1258124.html\" rel=\"noreferrer\" target=\"_blank\">seen by Spiegel,<\/a> the Christian Democratic Union wants to allow users to upload any content they want, making content recognition technologies \u2014 called \u201cupload filters\u201d by critics \u2014 unnecessary. Platforms such as Googles YouTube would then have to compensate right holders with what could be a flat rate.<\/p>\n<p>Greens MEP Julia Reda <a href=\"https:\/\/twitter.com\/Senficon\/status\/1106969755829846017\" rel=\"noreferrer\" target=\"_blank\">called<\/a> the plan a \u201csham,\u201d arguing such an interpretation of the legislation is not possible under EU law, because the so-called Infosoc directive does not allow it.<\/p>\n<p><strong>RIGHTS HOLDERS WRITE TO YOUTUBE CEO:<\/strong> Europe for Creators, an umbrella organization of rights holders, wants to run ads on the Google-owned platform this week and be granted access to YouTubers who have taken part in the debate in response to YouTubes Save the Internet campaign, conducted on the platform itself. \u201cYouTube has been actively using its own services to influence public opinion, often with misleading or false information,\u201d <a href=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2019\/03\/Letter-to-Susan-Wojcicki.pdf\" rel=\"noreferrer\" target=\"_blank\">the letter<\/a> reads.<\/p>\n<table>\n<tbody>\n<tr>\n<td>AROUND THE BLOC<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>FRENCH LABOR COURT WONT DECIDE ON UBER CASE: <\/strong>The Lyon labor court \u2014 Conseil de Prudhommes \u2014 will not rule on a case asking for an Uber drivers qualification as an employee. It will instead be referred to a commercial court, according to the ruling seen by Morning Tech. The driver, who has his own company, signed a partnership agreement with Uber and therefore cannot be considered as an employee. \u201cDrivers can decide to connect in realtime and with no exclusivity condition. This new decision by the Lyon labor court confirms this freedom of choice is possible,\u201d a spokesperson for Uber said in a statement.<\/p>\n<p><strong>GERMAN 5G SPECTRUM AUCTION WILL START THIS WEEK AS PLANNED:<\/strong> A German court dismissed Deutsche Telekom, Telef\u00f3nica and Vodafones challenge against the coverage obligations attached to the auction, <a href=\"https:\/\/www.ft.com\/content\/af1f0a84-4702-11e9-b168-96a37d002cd3\" rel=\"noreferrer\" target=\"_blank\">the Financial Times<\/a> reported. The auction will kick off on March 19.<\/p>\n<table>\n<tbody>\n<tr>\n<td>BEST OF THE REST<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><a href=\"https:\/\/www.politico.eu\/pro\/digital-tax-spat-spurs-global-battle-over-corporate-tax\/\" rel=\"noreferrer\" target=\"_blank\">How the digital tax spat<\/a> opened the door to a global showdown over changing corporate taxation rules, with the U.S. and China on one side, and France and Germany on the other, by POLITICOs Bjarke Smith-Meyer.<\/p>\n<p>Facebooks crisis management algorithm runs on outrage, <a href=\"https:\/\/www.bloomberg.com\/features\/2019-facebook-neverending-crisis\/?srnd=businessweek-v2\" rel=\"noreferrer\" target=\"_blank\">on Bloomberg<\/a>, and also Facebooks announcement about its new AI tool to fight revenge porn, <a href=\"https:\/\/www.theverge.com\/2019\/3\/15\/18266974\/facebook-instagram-revenge-porn-ai-filter\" rel=\"noreferrer\" target=\"_blank\">on the Verge<\/a>.<\/p>\n<p><a href=\"https:\/\/www.merics.org\/sites\/default\/files\/2019-03\/190312_merics_Policy-Brief_Huawei_en_A4_final_web.pdf\" rel=\"noreferrer\" target=\"_blank\">This report<\/a> by the Mercator Institute for China Studies is doing the rounds with national policymakers focused on strategic autonomy and 5G security, and sets out a case for caution in allowing Huawei and other Chinese tech firms access to key parts of the European market.<\/p>\n<table>\n<tbody>\n<tr>\n<td>POLITICO PRO ARTICLES<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h3>Europes silver bullet in global AI battle: ethics<\/h3>\n<p>\u2014 By Janosch Delcker<\/p>\n<p>BERLIN \u2014 An act of genius, or slow suicide.<\/p>\n<p>Thats the range of opinions on Europes plan for catching up with the United States and China in the global artificial intelligence race.<\/p>\n<p>As American and Chinese companies dominate the AI battlefield, the EU has <a href=\"https:\/\/www.politico.eu\/article\/europe-commission-andrus-ansip-hopes-ethical-approach-will-be-its-edge-in-global-ai-artificial-intelligence-race\/\" rel=\"noreferrer\" target=\"_blank\">pinned its hopes<\/a> on becoming a world leader in what it calls \u201ctrustworthy\u201d artificial intelligence.<\/p>\n<p>By ensuring AI applications follow ethical guidelines and base decisions on transparent criteria, policymakers believe they can boost consumer confidence in European AI, providing the bloc with a silver bullet against competitors in Silicon Valley and Shenzhen.<\/p>\n<p>\u201cEthics and competitiveness are intertwined, theyre dovetailed,\u201d said Pekka Ala-Pietil\u00e4, who chairs the EUs high-level expert group on AI. \u201cWe need to create an environment where the use of AI is felt and seen as trustworthy.\u201d<\/p>\n<p>\u201cIf that kind of sustainably leveled playing field is established, that gives a great incentive for companies to create products or services where ethics is part of their competitive advantage,\u201d he added.<\/p>\n<p>Ala-Pietil\u00e4s group of 52 experts is set to release the final version of its broad guidelines for the ethical use of AI in April. Later this year, a second document will follow, listing recommendations for boosting European investment in AI. Its release was originally scheduled for May but will likely be pushed back to the early summer.<\/p>\n<p>The two documents wont be binding, but they will provide lawmakers with a roadmap for regulating the emerging technology. The next European Commission, which takes office at the end of the year, is expected to make a priority of tackling AI.<\/p>\n<p>The EUs AI experts remain divided about what rules are needed, according to conversations with nine members of the group \u2014 but theyre united in their belief that an ethics-first approach will eventually allow Europe to set global standards for AI.<\/p>\n<p>The political leaders at the European Commission agree.<\/p>\n<p>\u201cI am personally convinced that ethical guidelines will be enablers of innovation for artificial intelligence,\u201d <a href=\"https:\/\/ec.europa.eu\/commission\/commissioners\/2014-2019\/gabriel\/announcements\/opening-speech-commissioner-mariya-gabriel-ai-forum-helsinki_en\" rel=\"noreferrer\" target=\"_blank\">said<\/a> Digital Commissioner Mariya Gabriel. \u201cHistory will tell us we were right,\u201d is how her colleague, Justice Commissioner V\u011bra Jourov\u00e1, <a href=\"http:\/\/europa.eu\/rapid\/press-release_SPEECH-18-5883_en.htm\" rel=\"noreferrer\" target=\"_blank\">put it<\/a>.<\/p>\n<p>Not everybody is so sure.<\/p>\n<p>The EUs \u201csoftball\u201d approach to AI is \u201cnaive\u201d and will cause the bloc to lose out to the U.S. and China, said Daniel Castro, vice president of the Information Technology and Innovation Foundation (ITIF), a think tank whose board includes members from U.S. tech giants including Amazon, Apple, Google and Microsoft.<\/p>\n<p>Consumers care primarily about effectiveness \u2014 and an ethics-first approach will prevent Europe from coming up with competitive products, he said. \u201cIts like any other race: You can have the more ethical race car driver, but if his car is not faster, you are going to lose,\u201d Castro said.<\/p>\n<h3>Ethics vs. price<\/h3>\n<p>Theres no denying the potential for AI to transform entire industries. The technologys transformative power is often compared to breakthroughs like widespread electrification. Artificial intelligence is set to change the way people work, communicate, <a href=\"https:\/\/www.politico.eu\/article\/ai-doctors-cancer-treatment-deep-learning\/\" rel=\"noreferrer\" target=\"_blank\">treat diseases<\/a> and <a href=\"https:\/\/www.politico.eu\/article\/killer-robots-overran-united-nations-lethal-autonomous-weapons-systems\/\" rel=\"noreferrer\" target=\"_blank\">conduct wars<\/a>.<\/p>\n<p>The trouble is that potential comes with significant risks. The \u201cdeep learning\u201d underlying many of todays cutting-edge applications, for example, essentially trains AI systems by seeking out patterns in vast troves of data.<\/p>\n<p>The result is often highly effective, but it can also turn programs into black boxes, making it difficult \u2014 or even impossible \u2014 to discern the logic behind their decisions.
